    Your FINANCE COMMITTEE, to whom has been referred


SENATE BILL 205, as amended


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. Strike Senate Corporations and Transportation Committee Amendments 1, 5, 6 and 7.


    2. On page 5, line 11, strike "thirteen" and insert in lieu thereof "one nonvoting member and thirteen voting".


    3. On page 5, line 17, after "be" insert "a nonvoting member and".


    4. On page 5, line 22, strike "six" and insert in lieu thereof "seven".


    5. On page 6, line 8, strike "and".


    6. On page 6, line 10, strike the period and insert in lieu thereof "; and" and between lines 10 and 11, insert the following subparagraph:


                  "(g) one member appointed by the legislative finance committee.".


    7. On page 11, line 15, after the period insert:


    "The report shall contain an operating budget for the current fiscal year, a proposed budget for the next fiscal year, a list of the present employee positions and the salaries paid for each position and a list of all contracts entered into during the past fiscal year and the current fiscal year to date and the amount expended to date under each contract.".

    8. On page 12, line 20, after "a", strike the remainder of the line and strike line 21 up to the period and insert in lieu thereof "fourth degree felony and shall be punished by a fine of not more than twenty-five thousand dollars ($25,000) or by imprisonment for a definite term not to exceed eighteen months or both".


    9. On page 13, line 5, strike "governor or the governor's designee" and insert in lieu thereof "board".


    10. On page 14, between lines 24 and 25, insert the following new subsection:


         "C. An officer or employee of a university who is principally involved in research, public service, economic development or instruction may develop, create or commercialize new intellectual property for the state and encourage new opportunities for business and increased jobs. Intellectual property created by an employee or agent of a university associated with the research applications center shall be owned by the university. Intellectual property created jointly shall be owned jointly. If the intellectual property is created using federal funds, the applicable federal laws and regulations shall govern the ownership.".


    11. Reletter the succeeding subsection accordingly.


    12. On page 17, line 1 through page 18, line 3, strike Section 14 in its entirety.


    13. Renumber the succeeding sections accordingly.
