AN ACT

RELATING TO CONSTRUCTION INDUSTRIES; CREATING THE BUILDING INSPECTION FUND; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Construction Industries Licensing Act is enacted to read:

     "[NEW MATERIAL] BUILDING INSPECTION FUND--CREATED--BUILDING CODE ENFORCEMENT.--The "building inspection fund" is created in the state treasury to provide for building code enforcement. The fund consists of appropriations, gifts, grants, donations and fees collected by the division from municipal or county governments paid in remuneration for building code enforcement services in lieu of a local government's building code enforcement program. Money in the fund at the end of a fiscal year shall not revert to any other fund. The division shall administer the fund, and money in the fund is appropriated to the division for plan review, permitting and inspection of new construction and other code enforcement services within the jurisdictional boundaries of a local building code enforcement program. Disbursements from the fund shall be made by warrant of the secretary of finance and administration pursuant to vouchers signed by the director or the director's authorized representative."
