    Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

SENATE BILL 37

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 2, line 4, after "with", insert "Section 63-9A-9 NMSA 1978 and".

    2. On page 2, line 23, after "services", insert ", including interexchange carriers and competitive local exchange carriers,".

    3. On page 2, line 25, after the period, insert:

    "For any provider seeking a determination of effective competition under this section, the commission may impose consumer protection and quality of service rules on that provider consistent with the findings of effective competition and rules that are imposed on other providers offering service in the relevant market area. Any fines, penalties or credit requirements imposed for violation of consumer protection or service quality rules shall be limited by Section 63-7-23 NMSA 1978.".,

and thence referred to the JUDICIARY COMMITTEE.
