Your FINANCE COMMITTEE, to whom has been referred
HOUSE TAXATION AND REVENUE COMMITTEE SUBSTITUTE
FOR HOUSE BILL 3, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike Items 1 and 2 of House Floor Amendment number 1.
2. On page 1, line 17, after "TAX" insert "FOR EARLY CHILDHOOD PROGRAMS AND".
3. On page 3, line 20, strike the closing quotation mark and between lines 20 and 21, insert the following new subsections to read:
"I. A distribution pursuant to Section 7-1-6.1 NMSA 1978 shall be made to the public education department in an amount equal to five and eleven-hundredths percent of the net receipts, exclusive of penalties and interest, attributable to the cigarette tax and is appropriated to the public education department for fiscal year 2011 and shall be used for early childhood programs but shall be not used for administration or administrative purposes.
J. A distribution pursuant to Section 7-1-6.1 NMSA 1978 shall be made to the children, youth and families department for early childhood programs, including state-assisted child care, TEACH and other early childhood initiatives, in an amount equal to seven and eleven-hundredths percent of the net receipts, exclusive of penalties and interest, attributable to the cigarette tax and is appropriated to the children, youth and families department for fiscal year 2011."".
4. On page 11, line 21, after "state" insert "or".
