AN ACT

RELATING TO COURTS; CREATING THE JUDICIAL NOMINATING COMMISSION FUND; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

    SECTION 1. JUDICIAL NOMINATING COMMISSION FUND--CREATED.--

          A. The "judicial nominating commission fund" is created in the state treasury to be administered by the administrative office of the courts. The fund shall consist of appropriations, gifts, grants, donations and bequests made to the fund. Income from the fund shall be credited to the fund. Balances in the fund shall not revert to the general fund at the end of any fiscal year.

          B. Money in the judicial nominating commission fund is subject to appropriation by the legislature to the administrative office of the courts for the operation and costs of judicial nominating commissions, including the expense of organizing the commissions and per diem and mileage for commission members.

          C. Payments from the judicial nominating commission fund shall be made upon vouchers issued and signed by the director of the administrative office of the courts or the director's designee upon warrants drawn by the secretary of finance and administration.

    SECTION 2. APPROPRIATION.--Fifty thousand dollars ($50,000) is appropriated from the general fund to the judicial nominating commission fund for expenditure in fiscal year 2012 and subsequent fiscal years for the operation and costs of judicial nominating commissions. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
