AN ACT

RELATING TO PROBATE COURTS; INCREASING CERTAIN COPY AND CERTIFICATION FEES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 34-7-15 NMSA 1978 (being Laws 1923, Chapter 29, Section 2) is amended to read:

     "34-7-15. ADDITIONAL FEES.--In addition to the fees provided for in Section [1 hereof] 34-7-14 NMSA 1978, clerks of probate courts may charge the following fees:

          A. for making an itemized bill of costs in any case, when demanded, fifty cents ($.50);

          B. for making and certifying to transcript of judgment, one dollar ($1.00);

          C. for taking an acknowledgment and affixing seal, fifty cents ($.50), if but one person acknowledges, and twenty-five cents ($.25) for each additional person;

          D. for making copies of records or papers, [ten cents per folio of one hundred words, for carbon copies three cents per folio] one dollar ($1.00) per page;

          E. for certificate and seal authenticating any paper as a true and correct copy, [fifty cents] one dollar ($1.00), and for authenticating a paper with a triple seal, three dollars ($3.00); and

          F. for making transcripts on appeal or certiorari to any court and for certifying [the same, such] them, the fees as are [now] provided by law; provided, however, that only fees for certification shall be charged where the transcript is prepared by the litigant [himself]."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2012.
