FOR THE LAND GRANT COMMITTEE

 

A JOINT RESOLUTION

PROPOSING THE SALE OR TRADE OF REAL PROPERTY IN MCKINLEY AND SANDOVAL COUNTIES.

 

     WHEREAS, Section 13-6-2 NMSA 1978 provides that a state agency may sell or otherwise dispose of real property by negotiated sale to a local public body; and

     WHEREAS, Section 13-6-3 NMSA 1978 requires ratification and approval of any sale or trade or lease of more than twenty-five years of real property belonging to a state agency for a consideration of one hundred thousand dollars ($100,000) or more; and

     WHEREAS, the state game commission, a state agency, owns certain real property in McKinley and Sandoval counties, described as the Marquez wildlife management area, containing a total of fourteen thousand five hundred one and twenty-one hundredths acres, more or less, said portions being more particularly described as follows:

All that portion of Tract No. 5 (created, defined and described in the Final Decree in Cause No. 6113 on the Docket of the District Court in and for Bernalillo County, New Mexico, Roman L. Baca, et al. vs. Santiago Anaya, et al.) of the CEBOLLETA GRANT, reported as No. 46, by the United States Surveyor General for New Mexico, and confirmed by Act of Congress, approved March 3, 1869, WHICH LIES WITHIN McKINLEY COUNTY, NEW MEXICO, the said portion thereof within McKinley County, with a portion thereof lying in Sandoval County, being shown by Survey, made October 23, 1946, to March 21, 1947, by Ross-Beyer Engineering Office to be described as follows: BEGINNING at the Northeast corner, which is the point of intersection of the North Boundary of the Cebolla Grant with the line between McKinley and Sandoval Counties, which is the Closing Corner of Section 19, Township 14 North, Range 4 West, and Section 24, Township 14 North, Range 5 West, NMPM, on the North Boundary of the Cebolleta Grant; said point being 377.52 feet N 82° 12' W along said Grant Boundary from the 5 1/2 mile Corner thereon, and run along the North Boundary of the Cebolleta Grant in the following courses:

Tract 12

Private Tract Number 12 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Southwest corner of which tract the U.S.G.S. Triangulation Station "AGUA" bears S 54° 21' 17" E 18,858.20 feet distant. The tract number is taken from Carlos Salazar's water rights map as filed with the State Engineer's Office being sheet No. 2 signed by the State Engineer October 9, 1959, and numbered declaration 01627. Said tract 12 is bounded on the North by Tract 15 the property of Leonardo Gonzales. On the East by the Peoples Tract. On the South by the Peoples Tract. On the West by Tract 24 and formerly the property of Eliseo Marquez and Tract 12 contains 6.50 acres more or less of land.

Tract 61

Private Tract Number 61 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Southwest corner of which tract the U.S.G.S. Triangulation Station "AGUA" bears S 58° 18' 09" E 20,023.89 feet distant. The tract number is taken from Carlos Salazar's water rights map as filed with the State Engineer's Office being sheet No. 2 signed by the State Engineer October 9, 1959, and numbered declaration 01627. Said tract 61 is bounded on the North by Tract 8 and Juan Tafoya Creek. On the East by Tract 48 and the Peoples Tract. On the South by the Peoples Tract. On the West by Tract 4. And contains 6.2 acres more or less.

Private Tract Number 8 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Northeast corner of which tract the U.S.G.S. Triangulation Station "AGUA" bears S 55° 57' 01" E 20,165.51 feet distant.

Said Tract 8 is bounded on the North by Tract 21 and Tract 47.

On the East by Tract 9 and the Peoples Tract.

On the West by Tract 21 and containing 2.50 acres more or less.

Tract 9

Private Tract Number 9 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Northeast corner of which tract the U.S.G.S. Triangulation Station "AGUA" bears S 55° 30' 52" E 20,060.28 feet distant.

Said Tract 9 is bounded on the North by Tract 47.

On the East by the Peoples Tract's road.

Tract 11

Private Tract Number 11 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Northeast corner of which tract the U.S.G.S. Triangulation Station "AGUA" bears S 54° 03' 34" E 20,028.02 feet distant.

Said Tract 11 is bounded on the North by the Juan Tafoya Peoples Tract road.

On the East by the Public School Grounds.

Said Tract 10 is bounded on the North by Juan Tafoya Peoples Tract road.

On the East by the Juan Tafoya Peoples Tract road.

On the South by Tract 6.

On the West by Juan Tafoya Peoples Tract road and the Public School ground and contains 1.30 acres of land more or less.

Tracts 57 and 59

Private Tracts 57 and 59 within the Juan Tafoya Peoples Tract on the Cebolleta Grant and from the Northeast corner of Tract 57 the U.S.G.S. Triangulation Station "AGUA" bears S 56° 56' 24" E 23,676.74 feet distant.

Said Tracts 57 and 59 lie adjoining one another, Tract 57 on the East and Tract 59 on the West and are bounded on the North by the Juan Tafoya Peoples Tract road.

Bounded on the East by Tract 3.

On the South by land of the New Mexico Game and Fish Department.

On the West by Tracts 1 and 58; Tract 57 contains 14.90 acres and Tract 59 contains 14.00 acres making a aggregate of 28.90 acres of land more or less.

Tract 49

     WHEREAS, the state game commission owns lots, containing a total of two hundred thirty-three acres, more or less, called town lots, in the vicinity of the village of Marquez in Sandoval county;

     WHEREAS, the Marquez wildlife management area and the town lots are located within the historical boundaries of the Cebolleta land grant as confirmed and patented by the federal government; and

     WHEREAS, the heirs of the Cebolleta land grant desire to reacquire lands within the historical boundaries of the grant; and

     WHEREAS, Section 13-6-5 NMSA 1978 requires a state agency to grant the first right of refusal to the board of trustees of a community land grant governed pursuant to the provisions of Chapter 49, Article 1 NMSA 1978 when selling real property belonging to the state agency; and

     WHEREAS, the state game commission and the Cebolleta land grant have conducted negotiations related to the sale or trade of the Marquez wildlife management area and town lots;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE

STATE OF NEW MEXICO that the state game commission be authorized to convey the real property described in this resolution to the Cebolleta land grant by negotiated sale or trade; and

     BE IT FURTHER RESOLVED that the state game commission may sell the described property to the Cebolleta land grant, or convey the same through land trade, and that the sale or trade is hereby ratified and approved pursuant to the provisions of Section 13-6-3 NMSA 1978, subject to the conditions of this resolution; and

     BE IT FURTHER RESOLVED that before the property is sold, or exchanged through land trade, all parcels shall be appraised by an appraiser or by appraisers that are mutually agreeable to the state game commission and the Cebolleta land grant; and

     BE IT FURTHER RESOLVED that as a condition of sale or land trade, the state game commission and the Cebolleta land grant shall enter into a purchase or other applicable agreement that is mutually agreeable to both parties; and

     BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the state game commission, the department of game and fish, the Cebolleta land grant and the appropriate legislative committee.
