A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO ARTICLE 4, SECTION 36 OF THE CONSTITUTION OF NEW MEXICO; ALLOWING FOR ADDITIONAL SANCTIONS AGAINST OFFICERS SUBJECT TO IMPEACHMENT PROCEEDINGS.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. It is proposed to amend Article 4, Section 36 of the constitution of New Mexico to read:

     "All state officers and judges of the district court shall be liable to impeachment for crimes, misdemeanors and malfeasance in office [but]. Judgment in such cases shall not extend further than removal from office and disqualification to hold any office of honor, trust or profit, or to vote under the laws of this state [but such] unless additional sanctions are provided in law. An officer or judge, whether convicted or acquitted, shall nevertheless be liable to prosecution, trial, judgment, punishment or civil action, according to law. No officer shall exercise any powers or duties of [his] the office after notice of [his] impeachment is served upon [him] the officer until [he] the officer is acquitted."

     SECTION 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
