AN ACT

RELATING TO ELECTRIC UTILITIES; ENACTING A NEW SECTION OF THE RURAL ELECTRIC COOPERATIVE ACT TO PROVIDE FOR ELECTRIC COOPERATIVES' SERVICE ON TRIBAL LANDS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Rural Electric Cooperative Act is enacted to read:

     "[NEW MATERIAL] OBLIGATION TO PROVIDE SERVICE ON TRIBAL LANDS.--A cooperative shall provide retail utility service on lands subject to the jurisdiction or control of a tribe pursuant to the same rates, rules and forms that are applicable to the cooperative's other members. As used in this section, "tribe" means an Indian nation, tribe or pueblo located in whole or in part within the state."
