AN ACT

RELATING TO PUBLIC ASSISTANCE; REQUIRING THE DEPARTMENT OF HEALTH TO PROVIDE AN ANNUAL REPORT ON THE DEVELOPMENTAL DISABILITIES MEDICAID HOME- AND COMMUNITY-BASED WAIVER PROGRAM.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] DEVELOPMENTAL DISABILITIES-- MEDICAID HOME- AND COMMUNITY-BASED SUPPORTS AND SERVICES-- ANNUAL REPORT WITH FIVE-YEAR COST PROJECTIONS.--By October 1, 2015 and by October 1 of each year thereafter, the department of health shall provide a report to the legislative finance committee and the legislative health and human services committee on the supports and services provided pursuant to the developmental disabilities medicaid home- and community-based waiver program. The report shall include:

          A. the number of individuals:

                (1) who are served in the developmental disabilities medicaid home- and community-based waiver program for each of the five most recent state fiscal years;

                (2) to whom developmental disability medicaid home- and community-based waiver program services were newly allocated during the previous state fiscal year, including the average length of time that individuals to whom services were newly allocated during the previous state fiscal year had awaited allocation on the central registry or waiting list before service allocation;

                (3) who are no longer served by the developmental disabilities medicaid home- and community-based waiver program each state fiscal year due to attrition;

                (4) awaiting allocation of developmental disabilities medicaid home- and community-based waiver program services on the central registry or waiting list at the end of each of the five state fiscal years;

                (5) who are added to the central registry or waiting list to await allocation of developmental disabilities medicaid home- and community-based waiver program services each state fiscal year; and

                (6) who are removed from the central registry or waiting list during each state fiscal year either due to being allocated developmental disabilities medicaid home- and community-based waiver program services or for other reasons;

          B. for each of the five most recent state fiscal years, the amount of state funds, if any, that the legislature has appropriated that:

                (1) exceeds the previous state fiscal year's allocation of state funds for the purpose of increasing the number of individuals served in the developmental disabilities medicaid home- and community-based waiver program for each state fiscal year; and

                (2) has reverted at the end of the state fiscal year;

          C. for each of the five most recent state fiscal years, the amount of state and federal funds expended for developmental disabilities medicaid home- and community-based waiver program services;

          D. a projection of the number of:

                (1) additional individuals who will be added to the central registry or waiting list each year over the next five state fiscal years, beginning with the fiscal year in which the report is submitted; and

                (2) individuals who will be awaiting allocation of developmental disabilities medicaid home- and community-based waiver program services on the central registry or waiting list at the beginning of each state fiscal year if no new additional funding were provided;

          E. a projection of the amount of additional state funding, in equal amounts over a five-year period, required to ensure that by the end of the five-year period there are no more than five hundred individuals awaiting allocation on the central registry or waiting list, taking into account the projected additions to the central registry or waiting list over the five-year period; and

          F. the amount of additional funding requested by the department of health, in its most recent budget submission to the legislative finance committee, for the purpose of increasing enrollment in the developmental disabilities medicaid home- and community-based waiver program and reducing the number of individuals awaiting allocation on the central registry or waiting list.
