    Your ENERGY, ENVIRONMENT AND NATURAL RESOURCES COMMITTEE, to whom has been referred

 

HOUSE BILL 140

 

has had it under consideration and reports same WITHOUT RECOMMENDATION, amended as follows:

 

     1. On page 4, line 14, strike "upon" and insert in lieu thereof "as part of the".

 

     2. On page 4, line 15, after the comma, strike "a" and insert in lieu thereof "the".

 

     3. On page 4, line 19, strike "that shall" and insert in lieu thereof:

 

"to be applied to customers who receive direct benefits of the gas infrastructure expansion activity and to any customers who reside or are located in the same or a directly adjacent county as the customers who receive direct benefits, and who receive indirect benefits of the gas infrastructure expansion activity, as determined by the commission. The allocation of infrastructure expansion rates between customers who receive direct benefits and those who receive indirect benefits in the same or a directly adjacent county shall be set by the commission following a hearing and notice. In setting and applying cost recovery methodologies through gas infrastructure expansion rates, the rules shall require that the commission".

 

     4. On page 4, line 20, strike "and" and insert in lieu thereof "with the interests of".

 

     5. On page 4, line 21, after "activity", insert "to ensure that no person is unjustly enriched at customers' expense".,

 

and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
