AN ACT

RELATING TO CRIMINAL LAW; ESTABLISHING THE CRIME OF ABSCONDING FROM PROBATION OR PAROLE; ENACTING PENALTIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] ABSCONDING FROM PROBATION OR PAROLE.--

          A. Absconding from probation or parole consists of any probationer or parolee who, while under the supervision of the adult probation and parole division of the corrections department, willfully:

                (1) changes residence from that which is on record with the division;

                (2) leaves the jurisdiction to which the probationer or parolee is restricted without permission; or

                (3) ceases to comply with reporting requirements.

          B. Whoever commits absconding from probation or parole where an offense for which the person has been granted probation or parole is a felony is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978."
