Mr. Speaker:

 

    Your HEALTH AND HUMAN SERVICES COMMITTEE, to whom has been referred

 

HOUSE BILL 288

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 1, line 14, after "ASSIGNMENT", strike the remainder of the line and strike line 15 through "PRACTICE" and insert in lieu thereof "UNDER CERTAIN CIRCUMSTANCES".

 

     2. On page 2, line 19, strike "and".

 

     3. On page 2, between lines 19 and 20, insert the following new subsection:

 

          "F. "patient abandonment" means a nurse's unilateral severance of an established nurse-patient relationship without giving reasonable notice in accordance with hospital policy so that arrangements can be made for continuation of nursing care by others; and".

 

     4. Reletter the succeeding subsection accordingly.

 

     5. On page 5, line 8, after the dash, insert the subsection designation "A.".

 

     6. On page 5, line 10, strike the subsection designation "A." and insert in lieu thereof the paragraph designation "(1)".

 

     7. On page 5, line 11, after the semicolon, insert "or".

 

     8. On page 5, line 12, strike the subsection designation "B." and insert in lieu thereof the paragraph designation "(2)".

 

     9. On page 5, line 13, strike "; or" and insert in lieu thereof a period.

 

     10. On page 5, lines 14 through 20, strike Subsection C in its entirety and insert in lieu thereof the following new subsection:

 

          "B. Nothing in this section shall be construed to equate a nurse's refusal of an assignment with patient abandonment.".

 

     11. On page 7, line 22, after the semicolon, insert "and".

 

     12. On page 7, lines 23 through 25, strike Paragraph (3) in its entirety and insert in lieu thereof the following new paragraph:

 

                "(3) the department issues a report and takes appropriate action to ensure that a hospital is in compliance with the provisions of the Patient Safe Staffing Act and department rules and any related orders; and".

 

     13. On page 8, lines 1 through 3, strike Paragraph (4) in its entirety.

 

     14. On page 8, line 18, after "that", strike the remainder of the line and strike lines 19 through 24 in their entirety and insert in lieu thereof "the department is not enforcing the provisions of the Patient Safe Staffing Act or any department rule promulgated pursuant to that act, the attorney general or a party aggrieved or potentially aggrieved by that violation may file suit in the district court of any county for injunctive relief to enforce the provisions of the Patient Safe Staffing Act or department rules.".,

 

 

and thence referred to the LABOR AND ECONOMIC DEVELOPMENT COMMITTEE.
