    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

 

HOUSE BILL 491

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

1. On page 1, strike line 25 in its entirety.

 

     2. On page 2, strike lines 1 through 5 in their entirety.

 

     3. Renumber the succeeding paragraphs accordingly.

 

     4. On page 2, line 20, strike "and".

 

     5. On page 2, line 23, before the period, insert:

 

     "; and

 

                (6) not charge a survivor of sexual assault a fee for collection of a sexual assault examination kit or otherwise deter the survivor from pursuing collection of a sexual assault examination kit".

 

     6. On page 5, between lines 1 and 2, insert the following new subsection:

 

          "F. A prosecutor shall not prosecute a survivor of sexual assault for minor criminal offenses, including underage consumption of alcohol, drug use or prostitution, if the evidence of the commission of the offense is obtained through the examination of and collection of a sexual assault examination kit from the survivor of sexual assault.".

 

     7. Reletter the succeeding subsection accordingly.,

 

 

and thence referred to the JUDICIARY COMMITTEE.
