    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 4, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 22, strike "seven" and insert in lieu thereof "eight".

    2. On page 1, line 24, after "Carlsbad", insert "or the mayor's designee".

    3. On page 1, line 25, strike ", or the mayor's designee".

    4. On page 2, line 10, strike "and".

    5. On page 2, between lines 10 and 11, insert the following new paragraph to read:

             "(7) the state engineer or the state engineer's designee; and".

    6. Renumber the succeeding paragraph accordingly.

    7. On page 2, line 14, strike "set" and insert in lieu thereof "recommend".

    8. On page 3, line 1, after the period, insert "The energy, minerals and natural resources department shall administer the fund.".

    9. On page 3, between lines 11 and 12, insert the following new subsection to read:

         "D. Money in the fund shall be disbursed on warrants signed by the secretary of finance and administration pursuant to vouchers signed by the secretary of energy, minerals and natural resources or the secretary's authorized representative.",

and thence referred to the FINANCE COMMITTEE.
