Mr. President:

    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

SENATE BILL 189

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 12, strike Subsection A in its entirety and insert in lieu thereof the following new subsection:

         "A. If an individual or an individual's authorized representative requests, pursuant to Subsection E of Section 24-14B-6 NMSA 1978, to exclude all of that individual's information from a health information organization or a health information exchange, the health information organization or health information exchange from which the individual's information is excluded shall not be liable for any harm caused by denying access to that individual's electronic health record.".

    2. On page 15, between lines 21 and 22, insert the following new paragraph:

             "(2) the department of information technology;".

    3. Renumber the succeeding paragraphs accordingly.,

and thence referred to the JUDICIARY COMMITTEE.
