Mr. Speaker:

 

    Your STATE GOVERNMENT, ELECTIONS AND INDIAN AFFAIRS COMMITTEE, to whom has been referred

 

HOUSE BILL 76

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

    1. On page 11, line 17, after "if", insert ", within ten years immediately preceding the date of submission of the permit application,".

 

    2. On page 11, lines 22 through 24, strike ", within ten years immediately preceding the date of submission of the permit application," and insert in lieu thereof "of any state or the United States".

 

    3. On page 12, between lines 15 and 16, insert the following subsection:

 

    "R. If an applicant or permittee whose permit is being considered for denial or revocation on any basis provided by Subsection P of this section has submitted an action plan that has been approved in writing by the secretary or director, and plan approval includes a period of operation under a conditional permit that will allow the applicant or permittee a reasonable opportunity to demonstrate its rehabilitation, the secretary or director may issue a conditional permit for a reasonable period of time.".

 

    4. Reletter the succeeding subsections accordingly.

 

    5. On page 12, line 16, strike "issued".

 

 

    6. On page 12, line 18, strike "required" and insert in lieu thereof "listed in Subsection P of this section".

 

    7. On page 12, line 19, strike the comma and after the period, insert "An existing permit holder shall provide such disclosure upon request by the department or local agency."".

 

 

8. On page 12, strike lines 20 through 25 in their entirety.,
