SENATE FLOOR AMENDMENT number ___1__ to SENATE TAX, BUSINESS AND TRANSPORTATION COMMITTEE SUBSTITUTE FOR SENATE BILL 84


Amendment sponsored by Senators Daniel A. Ivey-Soto and Katy M. Duhigg


    1. On page 4, line 8, strike the semicolon and insert in lieu thereof ", and the customer is by rate class:".


    2. On page 4, between lines 8 and 9, insert:


             "(1) a residential retail customer; or


             (2) a small commercial retail customer; provided that small commercial retail customers shall not consume more than forty percent of the aggregate of energy produced from each community solar facility;".

 

    3. On page 4, line 10, after the second occurrence of "a", insert "qualifying utility".


    4. On page 6, line 22, strike "twenty".


    5. On page 6, line 23, after "consumption", insert ", including the percentage of renewable energy provided pursuant to the renewable energy portfolio standard of the Energy Transition Act".


    6. On page 9, line 19, after "require", strike the remainder of the line, strike line 20 in its entirety, strike line 21 through "cap" and insert in lieu thereof "thirty percent of electricity produced from each community solar facility".


    7. On page 9, line 22, strike "In facilitation of this target, the" and insert in lieu thereof "The".

 

    8. On page 10, line 4, after "cap", insert ", consistent with Section 13-1-21 NMSA 1978 regarding resident business and resident veteran business preferences".


    9. On page 10, line 15, after "facility", insert ", such that a qualifying facility and its non-subscribing customers do not subsidize the costs attributable to the subscriber organization pursuant to this paragraph".


    10. On page 10, line 22, after "terms", insert ", security interests".


    11. On page 10, line 24, after "subscription", insert ", as well as grievance and enforcement procedures".


    12. On page 11, line 4, after "charges", insert ", and provided that non-subscribers do not subsidize costs attributable to subscribers".


    13. On pages 12 and 13, strike Section 9 in its entirety.


    14. Renumber the succeeding sections accordingly.
