Section 30-9-14 NMSA 1978 (being Laws 1975, | 0019| Chapter 109, Section 5) is amended to read: | 0020| "30-9-14. INDECENT EXPOSURE.-- | 0021| A. Indecent exposure consists of a person | 0022| knowingly and intentionally exposing his primary genital area to | 0023| public view. | 0024| B. As used in this section, "primary genital area" | 0025| means the mons pubis, penis, testicles, mons veneris, vulva or | 0001| vagina. | 0002| [Whoever commits indecent exposure before a child under | 0003| the age of thirteen is guilty of a misdemeanor. | 0004| Whoever commits indecent exposure before a person thirteen | 0005| years of age or older is guilty of a petty misdemeanor.] | 0006| C. Whoever commits indecent exposure before a child | 0007| under the age of eighteen is guilty of a fourth degree felony. | 0008| D. Whoever commits indecent exposure before a | 0009| person eighteen years of age or older is guilty of a | 0010| misdemeanor. Upon a second or subsequent conviction for | 0011| committing indecent exposure before a person eighteen years of | 0012| age or older, the offender is guilty of a fourth degree | 0013| felony." | 0014| Section 2. A new section of the Criminal Code is enacted | 0015| to read: | 0016| "[NEW MATERIAL] AGGRAVATED INDECENT EXPOSURE.-- | 0017| A. Aggravated indecent exposure consists of a person | 0018| knowingly and intentionally exposing his primary genital area to | 0019| public view while committing one or more of the following | 0020| criminal offenses: | 0021| (1) assault, as provided in Section 30-3-1 NMSA | 0022| 1978; | 0023| (2) aggravated assault, as provided in Section | 0024| 30-3-2 NMSA 1978; | 0025| (3) assault with intent to commit a violent | 0001| felony, as provided in Section 30-3-3 NMSA 1978; | 0002| (4) battery, as provided in Section 30-3-4 NMSA | 0003| 1978; or | 0004| (5) aggravated battery, as provided in Section | 0005| 30-3-5 NMSA 1978. | 0006| B.
