0013|     PRIMARY CARE CLINICS; ENACTING A NEW SECTION OF THE PUBLIC

0014|     ASSISTANCE ACT.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  A new section of the Public Assistance Act is
    |
0018|     enacted to read:
    |
0019|       "[<u>NEW MATERIAL</u>] MEDICAID PAYMENTS FOR PRIMARY CARE
    |
0020|     CLINICS--MEDICAID CONTRACTS FOR MANAGED CARE REQUIRED TO INCLUDE
    |
0021|     PRIMARY CARE CLINICS.--
    |
0022|            A.  In providing payments under the medicaid program,
    |
0023|     the human services department shall ensure that a community-based primary care clinic that was a federally qualified health
    |
0024|     center in 1995 under the federal act shall receive for at least
    |
0025|     the same amount and type of services rendered in all subsequent
    |
0001|     years at least the same amount of total payments under the
    |
0002|     medicaid program as the primary care clinic received in the
    |
0003|     calendar year ending December 31, 1995.
    |
0004|            B.  In administering the medicaid program, the human
    |
0005|     services department shall ensure that any managed care program
    |
0006|     for medicaid, whether implemented through a federal waiver,
    |
0007|     block grant program or otherwise, shall require a health plan
    |
0008|     participating in the managed care program to contract with and
    |
0009|     provide timely payments at least monthly to each primary care
    |
0010|     clinic in the health plan's service area that was or would have
    |
0011|     qualified as a federally qualified health center in 1995 under
    |
0012|     the federal act."
