NICELY | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO CAPITAL EXPENDITURES; EXTENDING EXPENDITURE PERIODS; | 0013| EXPANDING PURPOSES; MAKING APPROPRIATIONS; DECLARING AN | 0014| EMERGENCY. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. GENERAL FUND--GENERAL SERVICES DEPARTMENT--EXTENDING EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding | 0018| the provisions of Paragraph (3) of Subsection A of Section 71 of | 0019| Chapter 148 of Laws 1994, the period of time in which the | 0020| following appropriations to the property control division of the | 0021| general services department made in Laws 1993, Chapter 366 may | 0022| be expended shall be extended through fiscal year 1998: | 0023| A. from the general fund to bring state buildings | 0024| into compliance with the federal Americans with Disabilities Act | 0025| of 1990 pursuant to Subsection M of Section 3; and | 0001| B. from the general fund operating reserve to | 0002| construct and equip a state library, records and archives | 0003| building pursuant to Subsection O of Section 4. | 0004| Section 2. GENERAL FUND--GENERAL SERVICES DEPARTMENT--EXTENDING EXPENDITURE PERIOD--EXPANSION OF PURPOSE--APPROPRIATION.--Notwithstanding the provisions of Subparagraph | 0005| (a) of Paragraph (3) of Subsection A of Section 71 of Chapter | 0006| 148 of Laws 1994, the appropriation from the general fund to the | 0007| property control division of the general services department | 0008| made in Subsection N of Section 3 of Chapter 366 of Laws 1993 | 0009| for a study committee and to plan for a comprehensive state | 0010| library, records and archives building is reauthorized and the | 0011| balance is appropriated for construction of the state library, | 0012| records and archives building. Any unexpended or unencumbered | 0013| balance remaining at the end of fiscal year 1998 shall revert to | 0014| the general fund. | 0015| Section 3. GENERAL FUND--DEPARTMENT OF PUBLIC SAFETY--EXTENDING EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding | 0016| the provisions of Paragraph (9) of Subsection A of Section 71 of | 0017| Chapter 148 of Laws 1994, the period of time in which the | 0018| appropriation from the general fund to the department of public | 0019| safety for a training building at the department training | 0020| facility in Santa Fe county made in Subsection JJ of Section 4 | 0021| of Chapter 366 of Laws 1993 may be expended shall be extended | 0022| through fiscal year 1997. | 0023| Section 4. SEVERANCE TAX BONDS--GENERAL SERVICES | 0024| DEPARTMENT--EXTENDING EXPENDITURE PERIOD--APPROPRIATION.--The | 0025| period of time in which the following appropriations from | 0001| severance tax bond proceeds to the property control division of | 0002| the general services department made in Laws 1993, Chapter 367, | 0003| Section 14 may be expended shall be extended through fiscal year | 0004| 1997: | 0005| A. to acquire a building and land for a primary | 0006| health care facility located in Chaves county pursuant to | 0007| Subsection C; | 0008| B. to plan, design and construct a secure treatment | 0009| cottage at the Las Vegas medical center located in San Miguel | 0010| county pursuant to Subsection D; | 0011| C. to plan and design a facility to house the | 0012| administration and provide a controlled visitor center at the | 0013| New Mexico boys' school located in Colfax county pursuant to | 0014| Subsection E; | 0015| D. to plan and design a multipurpose recreation | 0016| center at the Sequoyah treatment center located in Bernalillo | 0017| county pursuant to Subsection F; | 0018| E. to remove and replace the north and south roofs | 0019| at the penitentiary of New Mexico located in Santa Fe county | 0020| pursuant to Subsection K; | 0021| F. to repair the education building at the New | 0022| Mexico boys' school at Springer located in Colfax county | 0023| pursuant to Subsection L; | 0024| G. to replace the steam condensation lines in | 0025| building 300 of the New Mexico rehabilitation center located in | 0001| Chaves county pursuant to Subsection M; | 0002| H. to renovate the Los Lunas medical center located | 0003| in Valencia county in order to comply with the Americans with | 0004| Disabilities Act of 1990 pursuant to Subsection P; | 0005| I. to renovate the electrical system of building 300 | 0006| of the New Mexico rehabilitation center located in Chaves county | 0007| pursuant to Subsection Q; | 0008| J. to construct and provide access to a dining and | 0009| activities area at the New Mexico veterans' center located in | 0010| Sierra county pursuant to Subsection R; | 0011| K. to remodel the national guard complex on | 0012| Cerrillos road located in Santa Fe county for moving and other | 0013| expenses of any state agency that will occupy space in this | 0014| complex pursuant to Subsection X; | 0015| L. to complete phase one of the renovation of the | 0016| Bataan memorial building located in Santa Fe county pursuant to | 0017| Subsection Y; and | 0018| M. for planning, designing and constructing a state | 0019| police headquarters in Hobbs located in Lea county pursuant to | 0020| Subsection Z. | 0021| Section 5. SEVERANCE TAX BONDS--GENERAL SERVICES | 0022| DEPARTMENT--EXTENDING EXPENDITURE PERIOD--CHANGE IN PURPOSE--APPROPRIATION.--Notwithstanding the provisions of Subsection D | 0023| of Section 1 of Chapter 367 of Laws 1993, the balance of the | 0024| proceeds from the sale of severance tax bonds appropriated to | 0025| the property control division of the general services | 0001| department, pursuant to Subsection S of Section 14 of Chapter | 0002| 367 of Laws 1993, to remodel Sierra cottage at Fort Stanton | 0003| hospital shall not be expended for its original purpose but is | 0004| reauthorized and appropriated to the property control division | 0005| of the general services department to repair and renovate | 0006| buildings at Fort Stanton hospital located in Lincoln county. | 0007| Any unexpended or unencumbered balance remaining at the end of | 0008| fiscal year 1998 shall revert to the severance tax bonding fund. | 0009| Section 6. SEVERANCE TAX BONDS--GENERAL SERVICES | 0010| DEPARTMENT--CHANGE OF PURPOSE.--Notwithstanding the provisions | 0011| of Subsection H of Section 13 of Chapter 148 of Laws 1994, the | 0012| balance of the proceeds from the sale of severance tax bonds | 0013| appropriated to the property control division of the general | 0014| services department to remodel and make other needed | 0015| modifications and improvements to convert the Socorro cottage at | 0016| Fort Stanton hospital to a long-term care nursing facility shall | 0017| not be expended for its original purpose but is reauthorized and | 0018| appropriated to the property control division of the general | 0019| services department to repair and renovate buildings at Fort | 0020| Stanton hospital located in Lincoln county. | 0021| Section 7. PROCEEDS OF SALE OF LAND--GENERAL SERVICES | 0022| DEPARTMENT--EXTENDING EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding the provisions of Laws 1994, Chapter 148, | 0023| Section 41, the period of time in which the proceeds from the | 0024| sale by the property control division of the general services | 0025| department of the property that is located at the southeast | 0001| corner of St. Michael's drive at St. Francis drive in the city | 0002| of Santa Fe and that was purchased with money appropriated from | 0003| the capital projects fund to the capital program fund pursuant | 0004| to Paragraph (12) of Subsection B of Section 2 of Chapter 315 of | 0005| Laws 1989 for the purpose of constructing and equipping the | 0006| state library, archives and records center to be located in | 0007| Santa Fe county may be expended shall be extended through fiscal | 0008| year 1998. | 0009| Section 8. GENERAL FUND--CAPITAL PROGRAM FUND--EXTENDING | 0010| EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding the | 0011| provisions of Subsection A of Section 43 of Chapter 148 of Laws | 0012| 1994, the period of time in which the appropriations from the | 0013| general fund to the capital program fund made in Laws 1994, | 0014| Chapter 148, Section 43 may be expended shall be extended | 0015| through fiscal year 1997: | 0016| A. to continue the construction, renovation and | 0017| repair of state buildings throughout the state to comply with | 0018| the federal Americans with Disabilities Act of 1990 pursuant to | 0019| Subsection C; | 0020| B. for the planning, design and engineering of phase | 0021| one of the renovation of Turquoise lodge pursuant to Subsection | 0022| D; and | 0023| C. to design, plan, construct, equip and furnish an | 0024| addition to the Albuquerque office of the New Mexico commission | 0025| for the blind pursuant to Subsection E. | 0001| Section 9. GENERAL FUND--GENERAL SERVICES DEPARTMENT--EXTENDING EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding | 0002| the provisions of Subsection B of Section 52 of Chapter 148 of | 0003| Laws 1994, the period of time in which the appropriation from | 0004| the general fund to the general services department to plan, | 0005| design, construct, furnish or equip a secure forensic treatment | 0006| facility at the Las Vegas medical center located in San Miguel | 0007| county may be expended shall be extended through fiscal year | 0008| 1997. | 0009| Section 10. EMPLOYMENT SECURITY DEPARTMENT FUND--EXTENDING | 0010| EXPENDITURE PERIOD--APPROPRIATIONS.--Notwithstanding the | 0011| provisions of Subsection A of Section 54 of Chapter 148 of Laws | 0012| 1994, the period of time in which the following appropriations | 0013| from the employment security department fund to the capital | 0014| program fund in Laws 1994, Chapter 148, Section 54 may be | 0015| expended shall be extended through fiscal year 1997: | 0016| A. to make certain improvements to the Alamogordo | 0017| office of the labor department located in Otero county in order | 0018| to comply with the federal Americans with Disabilities Act of | 0019| 1990 pursuant to Paragraph (1); | 0020| B. to make certain improvements to the Albuquerque | 0021| office of the labor department located in Bernalillo county in | 0022| order to comply with the federal Americans with Disabilities Act | 0023| of 1990 pursuant to Paragraph (2); | 0024| C. to modify or make certain improvements to the | 0025| Artesia office of the labor department located in Eddy county, | 0001| including modifications that will comply with the federal | 0002| Americans with Disabilities Act of 1990, pursuant to Paragraph | 0003| (3); | 0004| D. to modify or make certain improvements to the | 0005| Farmington office of the labor department located in San Juan | 0006| county, including modifications that will comply with the | 0007| federal Americans with Disabilities Act of 1990, pursuant to | 0008| Paragraph (5); | 0009| E. to modify or make certain improvements to the Las | 0010| Cruces office of the labor department located in Dona Ana | 0011| county, including modifications that will comply with the | 0012| federal Americans with Disabilities Act of 1990, pursuant to | 0013| Paragraph (7); | 0014| F. to modify or make certain improvements to the Las | 0015| Vegas office of the labor department located in San Miguel | 0016| county, including modifications that will comply with the | 0017| federal Americans with Disabilities Act of 1990, pursuant to | 0018| Paragraph (8); | 0019| G. to modify or make certain improvements to the | 0020| Santa Fe office of the labor department located in Santa Fe | 0021| county, including modifications that will comply with the | 0022| federal Americans with Disabilities Act of 1990, pursuant to | 0023| Paragraph (9); | 0024| H. to modify, renovate, expand or make certain | 0025| improvements to the Silver City office of the labor department | 0001| located in Grant county, including modifications that will | 0002| comply with the federal Americans with Disabilities Act of 1990, | 0003| pursuant to Paragraph (10); and | 0004| I. to modify or make certain improvements to the | 0005| Tiwa building of the labor department located in Bernalillo | 0006| count in order to comply with the federal Americans with | 0007| Disabilities Act of 1990 pursuant to Paragraph (11). | 0008| Section 11. EMPLOYMENT SECURITY DEPARTMENT FUND--EXTENDING | 0009| EXPENDITURE PERIOD--APPROPRIATION.--Notwithstanding the | 0010| provisions of Laws 1995, Chapter 41, Sections 1 and 2, the | 0011| period of time in which the appropriations from the employment | 0012| security department fund to the property control division of the | 0013| general services department may be expended shall be extended | 0014| through fiscal year 1997: | 0015| A. for acquisition of, remodeling or renovating an | 0016| existing building for an office for the labor department in the | 0017| Deming area in Luna county pursuant to Section 1; and | 0018| B. for the purpose of acquiring, remodeling and | 0019| renovating an existing building for an office for the labor | 0020| department in the Deming area in Luna county pursuant to Section | 0021| 2. | 0022| Section 12. GENERAL FUND--GENERAL SERVICES DEPARTMENT--ENCUMBERED BALANCE--APPROPRIATION.--The encumbered balance from | 0023| the general fund appropriation pursuant to Subsection G of | 0024| Section 3 of Chapter 147 of Laws 1994 is reauthorized and | 0025| appropriated to the general services department to purchase | 0001| vehicles for state agencies and provide for required alternative | 0002| fuels conversion. | 0003| Section 13. EMERGENCY.--It is necessary for the public | 0004| peace, health and safety that this act take effect immediately. | 0005|  |
