0012| RELATING TO LICENSING; AMENDING THE HOISTING OPERATORS SAFETY

0013| ACT TO EXEMPT CERTAIN EQUIPMENT FROM ITS COVERAGE.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 60-15-3 NMSA 1978 (being Laws 1993,
|
0017| Chapter 183, Section 3, as amended) is amended to read:
|
0018| "60-15-3. DEFINITIONS.--As used in the Hoisting Operators
|
0019| Safety Act:
|
0020| A. "class I hoisting operator" means any person who
|
0021| is authorized to operate a conventional crane, tower crane or
|
0022| hydraulic crane of any size or weight;
|
0023| B. "class II hoisting operator" means any person who
|
0024| is authorized to operate:
|
0025| (1) a hydraulic crane of up to one hundred tons
|
0001| lifting capacity with a maximum boom length of one hundred fifty
|
0002| feet, regardless of mounting or means of mobility; and
|
0003| (2) any other type or size of crane or hoisting
|
0004| equipment under the direct supervision of a class I hoisting
|
0005| operator;
|
0006| C. "class III hoisting operator" means any person
|
0007| who is authorized to work as an apprentice, trainee or crane
|
0008| oiler or driver under the direct supervision of a class I or
|
0009| class II hoisting operator;
|
0010| D. "council" means the hoisting operators licensure
|
0011| examining council;
|
0012| E. "crane" means a tower crane used in construction,
|
0013| demolition or excavation work; a hydraulic crane; a
|
0014| power-operated derrick; or a mobile, carrier-mounted, track or
|
0015| crawler type power-operated hoisting machine that utilizes a
|
0016| power-operated boom capable of lateral movement by the rotation
|
0017| of the machine on the carrier. "Crane" does not include a
|
0018| crane, except as provided in Subsection M of this section;
|
0019| F. "department" means the regulation and licensing
|
0020| department;
|
0021| G. "endorsement" means the authorization stamped on
|
0022| a class I hoisting operator's license indicating authorization
|
0023| to operate a conventional crane, a tower crane or a hydraulic
|
0024| crane of any size or weight;
|
0025| H. "hoisting equipment" means, except as provided in
|
0001| Subsection M of this section:
|
0002| (1) a tower crane;
|
0003| (2) a hydraulic crane with over two tons
|
0004| lifting capacity;
|
0005| (3) a derrick crane; or
|
0006| (4) a mobile cable crane;
|
0007| I. "licensee" means any person licensed under the
|
0008| Hoisting Operators Safety Act;
|
0009| J. "person" means an individual, firm, partnership,
|
0010| corporation, association or other organization or any
|
0011| combination thereof;
|
0012| K. "seat time" means the actual hands-on operation
|
0013| of a crane by a class II hoisting operator while under the
|
0014| direct supervision of a licensed class I hoisting operator or by
|
0015| a class III hoisting operator while under the direct supervision
|
0016| of a licensed class I or II hoisting operator;
|
0017| L. "superintendent" means the superintendent of
|
0018| [the] regulation and licensing [department]; and
|
0019| M. "crane" or "hoisting equipment" does not include:
|
0020| (1) any crane or hoisting equipment used in
|
0021| construction, demolition or excavation associated with:
|
0022| [(1)] (a) natural gas gather lines;
|
0023| [(2)] (b) interstate transmission
|
0024| facilities and interstate natural gas facilities subject to the
|
0025| federal Natural Gas Pipeline Safety Act of 1968 and its
|
0001| amendments;
|
0002| [(3)] (c) interstate pipeline
|
0003| facilities and carbon dioxide pipeline facilities subject to the
|
0004| federal Hazardous Liquid Pipeline Safety Act of 1979;
|
0005| [(4)] (d) gas and oil pipeline
|
0006| facilities subject to the Pipeline Safety Act;
|
0007| [(5)] (e) mining, milling or smelting
|
0008| operations subject to mine safety and health administration
|
0009| regulations or occupational safety and health administration
|
0010| regulations;
|
0011| [(6)] (f) prefabricated control rooms
|
0012| of natural gas, oil or carbon dioxide pipeline transmission
|
0013| facilities;
|
0014| [(7)] (g) oil and gas exploration,
|
0015| production or drilling;
|
0016| [(8)] (h) rural electric cooperative
|
0017| and electric, gas and water utility operations;
|
0018| [(9)] (i) commercial sign operations;
|
0019| [(10)] (j) the construction or
|
0020| operation of railroads; or
|
0021| [(11)] (k) the installation and
|
0022| maintenance of telephone or television cable; or
|
0023| (2) a vehicle with a gross vehicle weight of
|
0024| fifteen thousand pounds or less with a mounted boom, such as a
|
0025| mechanic's heavy repair truck or a tire repair truck, not
|
0001| directly involved in construction, demolition or excavation
|
0002| work."
