Section 22-8-15 NMSA 1978 (being Laws 1967, | 0018| Chapter 16, Section 70, as amended by Laws 1993, Chapter 224, | 0019| Section 3 and also by Laws 1993, Chapter 227, Section 10) is | 0020| amended to read: | 0021| "22-8-15. ALLOCATION LIMITATION.-- | 0022| A. The department shall determine the allocations to | 0023| each school district from each of the distributions of the | 0024| public school fund, subject to the limits established by law. | 0025| B. During the 1996-97 school year, the department | 0001| shall distribute ninety-eight percent of all balances | 0002| appropriated to the state equalization guarantee distribution | 0003| pursuant to the provisions of Sections 22-8-18 through 22-8-25 | 0004| NMSA 1978. The department shall retain not less than two | 0005| percent of the appropriation to the state equalization guarantee | 0006| distribution for additional distributions made pursuant to | 0007| Section 22-8-25.2 NMSA 1978. | 0008| C. During the 1997-98 year, the department shall | 0009| distribute ninety-six and one-half percent of all balances | 0010| appropriated to the state equalization guarantee distribution | 0011| pursuant to the provisions of Sections 22-8-18 through 22-8-25 | 0012| NMSA 1978. The department shall retain not less than three and | 0013| one-half percent of the appropriation to the state equalization | 0014| guarantee distribution for additional distributions made | 0015| pursuant to Section 22-8-25.2 NMSA 1978. | 0016| D. During the 1998-99 and subsequent school years, | 0017| the department shall distribute ninety-five percent of all | 0018| balances appropriated to the state equalization guarantee | 0019| distribution pursuant to the provisions of Sections 22-8-18 | 0020| through 22-8-25 NMSA 1978. The department shall retain not less | 0021| than five percent of the appropriation to the state equalization | 0022| guarantee distribution for additional distributions made | 0023| pursuant to Section 22-8-25.2 NMSA 1978. | 0024| [B.] E. The local school board in each [local] | 0025| school district with authorized charter schools shall allocate | 0001| the appropriate distributions of the public school fund to | 0002| individual charter schools pursuant to each charter school's | 0003| school-based budget approved by the local school board and the | 0004| department. The local school board may retain an amount not to | 0005| exceed the school district's administrative cost relevant to | 0006| that charter school. | 0007| [C.] F. The local school board in each [local] | 0008| school district with authorized charter schools shall establish | 0009| an individual charter school account to receive public school | 0010| fund disbursements for each charter school." | 0011| Section 2. A new section of the Public School Finance Act, | 0012| Section 22-8-25.2 NMSA 1978, is enacted to read: | 0013| "22-8-25.2. [NEW MATERIAL] ADDITIONAL PER PUPIL | 0014| DISTRIBUTION FROM PUBLIC SCHOOL FUND.-- | 0015| A. After completion of the calculation of the state | 0016| equalization guarantee distribution pursuant to Sections | 0017| 22-8-18 through 22-8-25 NMSA 1978, the state superintendent | 0018| shall calculate the net operational expenditure per membership | 0019| for each school district for the prior school year and determine | 0020| a statewide average net operational expenditure per membership. | 0021| B. The state superintendent shall identify those | 0022| districts expending less than the average operational per | 0023| membership funding. Those districts expending less than the | 0024| average operational expenditure per membership shall be entitled | 0025| to an additional distribution, within the limits of available | 0001| balances, sufficient to bring each district to not less than: | 0002| (1) ninety percent of the average operational | 0003| expenditure per membership during the 1996-97 school year; | 0004| (2) ninety-two and one-half percent of the | 0005| average operational expenditure per membership during the 1997-98 school year; and | 0006| (3) ninety-five percent of the average | 0007| operational expenditure per membership during the 1998-99 and | 0008| subsequent school years. | 0009| C. The additional distribution provided pursuant to | 0010| Subsection B of this section shall be made on a per membership | 0011| basis, without regard to the number of program units in the | 0012| school district. A school district receiving an additional | 0013| distribution pursuant to this section shall share that | 0014| distribution with other school districts in the same county." | 0015| Section 3.
