0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0017|       Section 1.  Section 17-2-29 NMSA 1978 (being Laws 1953,
    |
0018|     Chapter 98, Section 1) is amended to read:
    |
0019|       "17-2-29. <u>HUNTING OR BOATING WHILE INTOXICATED
</u>    |
<u></u>0020| <u>    PROHIBITED</u>.--In order to prevent hunting and boating accidents
    |
0021|     and to promote the public safety, it <s>[shall hereafter be]</s> <u>is</u>

0022|     unlawful for any person <s>[while clearly intoxicated as a result

<s></s>0023| <s>    of drinking alcoholic liquors or]</s> <u>who has an alcohol

<u></u>0024| <u>    concentration of eight one-hundredths or more in his blood or

<u></u>0025| <u>    breath or is</u> under the influence of any narcotic drug, to hunt,

0001|     kill or attempt to take in any manner any game or nongame mammal

0002|     or bird, or to carry firearms of any kind or <s>[bow]</s> <u>bows</u> and

0003|     arrows in any hunting area or to go or to be upon the waters of

0004|     any lake in a boat or on a raft."
