APPROPRIATION.--One hundred sixty-eight | 0018| thousand dollars ($168,000) is appropriated from the general | 0019| fund to the department of health for expenditure in fiscal year | 0020| 1997 for the purpose of providing or contracting for a needle | 0021| exchange program, to include human immunodeficiency virus and | 0022| drug abuse counseling and intervention, one-to-one counseling, | 0023| behavior modification techniques, street outreach services and | 0024| services to women, children and minority communities, in any | 0025| class A county with a population of more than three hundred | 0001| thousand people. On page 1, strike lines 16 through 25, and on page 2, strike | 0015| lines 1 and 2 and insert in lieu thereof: | 0016| | 0017| "Section 1. [NEW MATERIAL] STERILE NEEDLE AND SYRINGE EXCHANGE | 0018| PILOT PROGRAM CREATED.--The department shall establish and administer a | 0019| sterile needle and syringe exchange pilot program. | 0020| | 0021| Section 2. [NEW MATERIAL] PURPOSE.--The purpose of the program | 0022| is to: | 0023| | 0024| A. prevent the transmission of the human immunodeficiency | 0025| virus, the hepatitis B virus and other blood borne diseases that occur | 0001| when sterile needles are not used during intravenous drug use; and | 0002| | 0003| B. provide intravenous drug users with referrals to | 0004| appropriate health and social services. | 0005| | 0006| Section 3. [NEW MATERIAL] DEFINITIONS.--As used in Sections 1 | 0007| through 6 of this act: | 0008| | 0009| A. "department" means the department of health; | 0010| | 0011| B. "participant" means an intravenous drug user who exchanges | 0012| a used needle and syringe unit for a sterile needle and syringe unit in | 0013| compliance with the procedures of the program; and | 0014| | 0015| C. "program" means the sterile needle and syringe exchange | 0016| pilot program. | 0017| | 0018| Section 4. [NEW MATERIAL] DEPARTMENT POWERS AND DUTIES.--The | 0019| department: | 0020| | 0021| A. shall establish procedures for implementing the program; | 0022| | 0023| B. shall compile research data that will assist in planning | 0024| and evaluating efforts to combat the spread of blood borne diseases; | 0025| | 0001| C. shall submit a report to the legislative health and human | 0002| services committee by October 1 of each year. The report shall include | 0003| evaluation and monitoring requirements and other pertinent information | 0004| regarding the effectiveness of the program; and | 0005| | 0006| D. may contract for services with private providers to | 0007| operate the program. | 0008| | 0009| Section 5. [NEW MATERIAL] PROGRAM PROCEDURE.--The program | 0010| shall: | 0011| | 0012| A. provide for free exchanges of sterile needles and syringes | 0013| for used needles and syringes; | 0014| | 0015| B. provide education to participants on the transmission of | 0016| the human immunodeficiency virus and prevention measures; and | 0017| | 0018| C. assist participants in obtaining substance abuse treatment | 0019| services. | 0020| | 0021| Section 6. [NEW MATERIAL] CRIMINAL LIABILITY.--Exchanges of | 0022| sterile needles and syringes under the program shall not constitute an | 0023| offense under the Controlled Substances Act for a participant, employee | 0024| of the department or its designee. No person shall be provided immunity | 0025| from prosecution for violating any law prohibiting or regulating the | 0001| use, possession, dispensing, distribution or promotion of drug | 0002| paraphernalia who is not participating in the program as a participant | 0003| or employee or designee of the department. | 0004| | 0005| Section 7. Section 30-31-25.1 NMSA 1978 (being Laws 1981, Chapter | 0006| 31, Section 2) is amended to read: | 0007| | 0008| "30-31-25.1. POSSESSION, DELIVERY, MANUFACTURE OR DELIVERY TO A | 0009| MINOR OF DRUG PARAPHERNALIA PROHIBITED.-- | 0010| | 0011| A. It is unlawful for any person to use or possess with | 0012| intent to use drug paraphernalia to plant, propagate, cultivate, grow, | 0013| harvest, manufacture, compound, convert, produce, process, prepare, | 0014| test, analyze, pack, repack, store, contain, conceal, inject, ingest, | 0015| inhale or otherwise introduce into the human body a controlled substance | 0016| in violation of the Controlled Substances Act. However, the provisions | 0017| of this subsection do not apply to a person using or possessing a | 0018| sterile needle or syringe while directly participating in a sterile | 0019| needle and syringe exchange pilot program administered by the department | 0020| of health. | 0021| | 0022| B. It is unlawful for any person to deliver, possess with | 0023| intent to deliver or manufacture with the intent to deliver drug | 0024| paraphernalia with knowledge, or under circumstances where one reason- | 0025| ably should know, that it will be used to plant, propagate, cultivate, | 0001| grow, harvest, manufacture, compound, convert, produce, process, | 0002| prepare, test, analyze, pack, repack, store, contain, conceal, inject, | 0003| ingest, inhale or otherwise introduce into the human body a controlled | 0004| substance in violation of the Controlled Substances Act. However, the | 0005| provisions of this subsection do not apply to an employee or designee of | 0006| the department of health who is delivering sterile needles or syringes | 0007| as part of a sterile needle and syringe exchange pilot program | 0008| administered by the department of health. | 0009| | 0010| C. Any person who violates this section with respect to | 0011| [(1)] Subsection A of this section is guilty of a misdemeanor and upon | 0012| conviction shall be punished by a fine of not less than fifty dollars | 0013| ($50.00) nor more than one hundred dollars ($100) or by imprisonment for | 0014| a definite term less than one year, or both. | 0015| | 0016| [(2)] D. Any person who violates this section with respect | 0017| to Subsection B of this section is guilty of a misdemeanor. | 0018| | 0019| [D.] E.
