0001| SENATE BILL 359 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND SESSION, | 0003| 1996 | 0004| INTRODUCED BY | 0005| SHANNON ROBINSON | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO COURTS; PROVIDING FOR AN ADDITIONAL JUDGE IN THE | 0013| BERNALILLO COUNTY METROPOLITAN COURT; VESTING THE NEW | 0014| METROPOLITAN COURT DIVISION WITH EXCLUSIVE JURISDICTION OVER | 0015| ACTIONS ARISING UNDER CERTAIN COUNTY AND MUNICIPAL ORDINANCES; | 0016| MAKING AN APPROPRIATION. | 0017| | 0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0019| Section 1. Section 34-8A-3 NMSA 1978 (being Laws 1979, | 0020| Chapter 346, Section 3, as amended) is amended to read: | 0021| "34-8A-3. METROPOLITAN COURT--JURISDICTION.-- | 0022| A. In addition to the jurisdiction provided by law | 0023| for magistrate courts, a metropolitan court shall have | 0024| jurisdiction within the county boundaries over all: | 0025| (1) offenses and complaints under ordinances of | 0001| the county and of any municipality located within the county in | 0002| which the court is located except municipalities with a | 0003| population of more than two thousand five hundred but less than | 0004| five thousand persons in the 1980 federal decennial census; | 0005| provided that the metropolitan court shall not have jurisdiction | 0006| over uncontested municipal parking violations; | 0007| (2) civil actions in which the debt or sum | 0008| claimed does not exceed five thousand dollars ($5,000) exclusive | 0009| of interest and costs; and | 0010| (3) contested violations of parking or | 0011| operation of vehicle regulations promulgated by a board of | 0012| regents of a state educational institution designated in Article | 0013| 12, Section 11 of the constitution of New Mexico located within | 0014| the county in which the court is located. | 0015| B. The metropolitan court for division sixteen | 0016| shall have exclusive jurisdiction within the Bernalillo county | 0017| metropolitan court over actions arising under county and | 0018| municipal ordinances regarding the following matters: | 0019| (1) zoning; | 0020| (2) environmental health; | 0021| (3) public works; | 0022| (4) fire; | 0023| (5) animal care; and | 0024| (6) regulations. | 0025| [B.] C. For the purposes of this section, | 0001| "uncontested violation" is a violation for which a citation has | 0002| been issued and the person has paid the citation by mail or in | 0003| person to the appropriate issuing authority; and "contested | 0004| violation" is a violation for which a citation has been issued | 0005| and the person had indicated his intent to contest the citation | 0006| or the person has not paid or answered the citation. | 0007| [C.] D. The issuing authority shall provide to | 0008| the metropolitan court on a mutually agreed schedule the unpaid | 0009| citations and a listing in a manner mutually agreed upon of | 0010| unpaid citations. | 0011| [D.] E. The municipality shall retain as | 0012| reimbursement for its expenses all revenues from uncontested | 0013| municipal parking violations." | 0014| Section 2. Section 34-8A-4.1 NMSA 1978 (being Laws 1981, | 0015| Chapter 318, Section 2, as amended) is amended to read: | 0016| "34-8A-4.1. METROPOLITAN COURT JUDGES--TERMS OF OFFICE--ELECTION.-- | 0017| A. The elected term of office for each judge of the | 0018| metropolitan court is four years. | 0019| B. Judges of the metropolitan court who have been | 0020| previously elected in a partisan election or who were serving as | 0021| metropolitan judges on January 1, 1989 in divisions one through | 0022| twelve shall be subject to retention or rejection on a | 0023| nonpartisan ballot at the 1990 general election for a four-year | 0024| term ending December 31, 1994. | 0025| C. Any person appointed to fill a vacancy on the | 0001| metropolitan court after January 1, 1989 shall serve until the | 0002| next general election. That person's successor shall be chosen | 0003| at that general election and shall hold the office until the | 0004| general election four years later. | 0005| D. Judges of the Bernalillo county metropolitan | 0006| court for divisions thirteen, fourteen and fifteen shall be | 0007| appointed and shall serve until the 1992 general election. | 0008| Their successors shall be chosen at that general election and | 0009| shall hold office until the general election four years later. | 0010| E. The judge of the Bernalillo county metropolitan | 0011| court for division sixteen shall be appointed pursuant to | 0012| Article 6, Section 37 of the constitution of New Mexico and | 0013| shall serve until the 1998 general election. The judge's | 0014| successor shall be chosen at that general election and shall | 0015| hold office until the general election four years later." | 0016| Section 3. Section 34-8A-8 NMSA 1978 (being Laws 1979, | 0017| Chapter 346, Section 8, as amended) is amended to read: | 0018| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.-- | 0019| A. The name of the metropolitan court in the | 0020| Bernalillo metropolitan district shall be the "Bernalillo county | 0021| metropolitan court". | 0022| B. The metropolitan court is an agency of the | 0023| judicial department of state government. Personnel of the | 0024| metropolitan court are subject to all laws and regulations | 0025| applicable to state officers and agencies and state officers and | 0001| employees, except where otherwise specifically provided by law. | 0002| C. There shall be [fifteen] sixteen judges of | 0003| the Bernalillo county metropolitan court." | 0004| Section 4. APPROPRIATION.--Two hundred thousand dollars | 0005| ($200,000) is appropriated from the general fund to the | 0006| Bernalillo county metropolitan court for expenditure in fiscal | 0007| year 1997 for the purpose of paying salaries and benefits and | 0008| providing furniture, equipment and supplies for a judge and | 0009| support staff. Any unexpended or unencumbered balance remaining | 0010| at the end of fiscal year 1997 shall revert to the general fund. | 0011| Section 5.
