0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|       Section 1.  Section 30-9-14 NMSA 1978 (being Laws 1975,
    |
0019|     Chapter 109, Section 5) is amended to read:
    |
0020|       "30-9-14.  INDECENT EXPOSURE.--
    |
0021|            <u>A.</u>  Indecent exposure consists of a person
    |
0022|     knowingly and intentionally exposing his primary genital area to
    |
0023|     public view.  
    |
0024|            <u>B.  As used in this section</u>, "primary genital area"
    |
0025|     means the mons pubis, penis, testicles, mons veneris, vulva or
    |
0001|     vagina.
    |
0002|       <s>[Whoever commits indecent exposure before a child under
</s>    |
<s></s>0003| <s>    the age of thirteen is guilty of a misdemeanor.
</s>    |
<s></s>0004| <s>      Whoever commits indecent exposure before a person thirteen
</s>    |
<s></s>0005| <s>    years of age or older is guilty of a petty misdemeanor.]

<s></s>0006| <s>           <u>C.  Whoever commits indecent exposure before a child

<u><s></u></s>0007| <u><s>    under the age of eighteen is guilty of a fourth degree felony.</u>

<s></s>0008| <s>           <u>D.  Whoever commits indecent exposure before a
</u></s>    |
<u><s></u></s>0009| <u><s>    person eighteen years of age or older is guilty of a
</u></s>    |
<u><s></u></s>0010| <u><s>    misdemeanor.  Upon a second or subsequent conviction for
</u></s>    |
<u><s></u></s>0011| <u><s>    committing indecent exposure before a person eighteen years of
</u></s>    |
<u><s></u></s>0012| <u><s>    age or older, the offender is guilty of a fourth degree
</u></s>    |
<u><s></u></s>0013| <u><s>    felony</u>."

<s></s>0014| <s>      Section 2.  A new section of the Criminal Code is enacted
</s>    |
<s></s>0015| <s>    to read:

<s></s>0016| <s>      "[<u>NEW MATERIAL</u>]  AGGRAVATED INDECENT EXPOSURE.--
</s>    |
<s></s>0017| <s>           A.  Aggravated indecent exposure consists of a person

<s></s>0018| <s>    knowingly and intentionally exposing his primary genital area to
</s>    |
<s></s>0019| <s>    public view while committing one or more of the following
</s>    |
<s></s>0020| <s>    criminal offenses:
</s>    |
<s></s>0021| <s>                (1)  assault, as provided in Section 30-3-1 NMSA
</s>    |

<s></s>0023| <s>                (2)  aggravated assault, as provided in Section

<s></s>0024| <s>    30-3-2 NMSA 1978;
</s>    |
<s></s>0025| <s>                (3)  assault with intent to commit a violent

<s></s>0001| <s>    felony, as provided in Section 30-3-3 NMSA 1978;

<s></s>0002| <s>                (4)  battery, as provided in Section 30-3-4 NMSA
</s>    |
<s></s>0003| <s>    1978; or
</s>    |
<s></s>0004| <s>                (5)  aggravated battery, as provided in Section
</s>    |
<s></s>0005| <s>    30-3-5 NMSA 1978.

<s></s>0006| <s>           B.  As used in this section, "primary genital area"

<s></s>0007| <s>    means the mons pubis, penis, testicles, mons veneris, vulva or

<s></s>0015| <s>      Section 3.  EFFECTIVE DATE.--The effective date of the

    |
0018|     of age;
    |
0019|                 (2)  assault, as provided in Section 30-3-1 NMSA
    |
0020|     1978;
    |
0021|                 (3)  aggravated assault, as provided in Section
    |
0022|     30-3-2 NMSA 1978;
    |
0023|                 (4)  assault with intent to commit a violent
    |
0024|     felony, as provided in Section 30-3-3 NMSA 1978;
    |
0025|                 (5)  battery, as provided in Section 30-3-4 NMSA
    |
0001|     1978;
    |
0002|                 (6)  aggravated battery, as provided in Section 30-3-5 NMSA 1978;
    |
0003|                 (7)  criminal sexual penetration, as provided in
    |
0004|     Section 30-9-11 NMSA 1978; or
    |
0005|                 (8)  abuse of a child, as provided in Section
    |
0006|     30-6-1 NMSA 1978.
    |
0007|            B.  As used in this section, "primary genital area" means
    |
0008|     the mons pubis, penis, testicles, mons veneris, vulva or vagina.
    |
0009|            C.  Whoever commits aggravated indecent exposure is guilty
    |
0010|     of a fourth degree felony.
    |
0011|            D.  In addition to any punishment provided pursuant to the
    |
0012|     provisions of this section, the court shall order a person
    |
0013|     convicted for committing aggravated indecent exposure to
    |
0014|     participate in and complete a program of professional counseling at
