0014|     SECTION OF THE ELECTION CODE; DECLARING AN EMERGENCY.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  Section 1-8-21 NMSA 1978 (being Laws 1994,
    |
0018|     Chapter 92, Section 2, as amended) is amended to read:
    |
0019|       "1-8-21.  PRIMARY ELECTION--METHODS OF PLACING NAMES ON
    |
0020|     PRIMARY BALLOT.--
    |
0021|            A.  <s>[All candidates]</s> <u>A candidate</u> seeking primary
    |
0022|     election nomination to a statewide office or the office of
    |
0023|     United States representative shall file <s>[declarations]</s> <u>a
</u>    |
<u></u>0024| <u>    declaration</u> of candidacy with the proper filing officer. 
    |
0025|     <s>[Candidates]</s> <u>A candidate</u> shall file <u>a</u> nominating
    |
0001|     <s>[petitions]</s> <u>petition</u> at the time of filing <s>[their
</s>    |
<s></s>0002| <s>    declarations]</s> <u>the declaration</u> of candidacy.  <s>[Candidates]</s>
    |
0003|     <u>A candidate</u> who <s>[seek]</s> <u>seeks</u>, but <s>[do]</s> <u>does</u> not
    |
0004|     obtain, preprimary convention designation by a major political
    |
0005|     party may file <u>a</u> new <s>[declarations]</s> <u>declaration</u> of
    |
0006|     candidacy and <u>a</u> nominating <s>[petitions]</s> <u>petition</u> pursuant
    |
0007|     to Section 1-8-33 NMSA 1978.
    |
0008|            B.  <s>[Candidates]</s> <u>A candidate</u> for <s>[any other

<s></s>0009| <s>    office]</s> <u>a legislative office, the office of district attorney,

<u></u>0010| <u>    district judge, metropolitan judge, magistrate judge or the

0002|         1.  On page 2, between lines 19 and 20, insert the following

0005|    "Section 2.  Section 1-8-21 NMSA 1978 (being Laws 1994, Chapter 92,

0006|   Section 2 is repealed effective January 1, 1997.

0008|    Section 3.  Effective January 1, 1997, a new Section 1-8-21 NMSA

    |

0018|   declarations of candidacy.  Candidates who seek, but do not obtain,

0019|   preprimary convention designation by a major political party may file
    |
0020|   new declarations of candidacy and nominating petitions pursuant to

0023|         B.  Candidates for any other office shall have their names
