0012|     AMENDING A SECTION OF THE PUBLIC SCHOOL FINANCE ACT TO ALLOW

0013|     MONEY IN THE PUBLIC SCHOOL TRANSPORTATION DISTRIBUTION TO BE
    |
0014|     USED FOR THE TRANSPORTATION OF PRIVATE SCHOOL STUDENTS.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  Section 22-8-26 NMSA 1978 (being Laws 1967,
    |
0018|     Chapter 16, Section 76, as amended) is amended to read:
    |
0019|       "22-8-26.  TRANSPORTATION DISTRIBUTION.--
    |
0020|            A.  Money in the transportation distribution of the
    |
0021|     public school fund shall be used only for the purpose of making
    |
0022|     payments to each school district for the to and from school
    |
0023|     transportation costs of students in grades kindergarten through
    |
0024|     twelve attending <u>a</u> public <u>or an accredited private</u> school
    |
0025|     within the school district and of three- and four-year-old
    |
0001|     children who meet the state board approved criteria and
    |
0002|     definition of developmentally disabled and for transportation of
    |
0003|     students to and from their regular attendance centers and the
    |
0004|     place where vocational education programs are being offered.
    |
0005|            B.  In the event a school district's transportation
    |
0006|     allocation exceeds the amount required to meet obligations to
    |
0007|     provide to and from transportation, three- and four-year-old
    |
0008|     developmentally disabled transportation and <s>[vocation]</s>
    |
0009|     <u>vocational</u> education transportation, the district shall revert
    |
0010|     remaining transportation funds to the transportation
    |
0011|     distribution in the department.
    |
0012|            C.  In the event the sum of the proposed
    |
0013|     transportation allocations to each school district exceeds the
    |
0014|     amounts in the transportation distribution, the allocation to
    |
0015|     each school district shall be reduced in the proportion that the
    |
0016|     local school district allocation bears to the total statewide
    |
0017|     transportation distribution.
    |
0018|            D.  Local school boards, with the approval of the
    |
0019|     state transportation director, may provide additional
    |
0020|     transportation services pursuant to Section 22-16-2 NMSA 1978 to
    |
0021|     meet established program needs."
