0012| RELATING TO JUDGES; PROVIDING FOR AN ADDITIONAL MAGISTRATE JUDGE

0013| IN SIERRA MAGISTRATE DISTRICT; PROVIDING FOR APPOINTMENT AND

0014| ELECTION; AMENDING A SECTION OF THE NMSA 1978; MAKING AN
|
0015| APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 35-1-30 NMSA 1978 (being Laws 1968,
|
0019| Chapter 62, Section 32) is amended to read:
|
0020| "35-1-30. MAGISTRATE COURT--SIERRA DISTRICT.--There shall
|
0021| be [one magistrate] two magistrates in Sierra magistrate
|
0022| district, with [a] divisions 1 and 2 operating as a single
|
0023| court in Truth or Consequences."
|
0024| Section 2. TEMPORARY PROVISION--APPOINTMENT AND ELECTION--DIVISION 2.--
|
0025| A. The office of magistrate in Sierra magistrate
|
0001| district division 2 shall be filled by appointment of the
|
0002| governor. The appointed magistrate shall begin serving January
|
0003| 1, 1997 and shall serve until succeeded by a magistrate elected
|
0004| pursuant to Subsection B of this section.
|
0005| B. The first full term of the office of magistrate
|
0006| in Sierra magistrate district division 2 shall be filled by
|
0007| election at the general election in 1998, and that term of
|
0008| office shall begin on January 1, 1999.
|
0009| Section 3. APPROPRIATION.--Thirty-five thousand dollars
|
0010| ($35,000) is appropriated from the general fund to the
|
0011| administrative office of the courts for expenditure in fiscal
|
0012| year 1997 for salary, benefits, office space and supplies for
|
0013| one new magistrate judge in Sierra magistrate district division
|
0014| 2. Any unexpended or unencumbered balance remaining at the end
|
0015| of fiscal year 1997 shall revert to the general fund.
