0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0013| SEVERANCE TAX BONDS FOR VARIOUS CAPITAL PROJECTS IN THE CITY OF
|
0014| CLOVIS IN CURRY COUNTY; MAKING APPROPRIATIONS; DECLARING AN
|
0015| EMERGENCY.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0019| APPROPRIATION OF PROCEEDS.--
|
0020| A. The state board of finance may issue and sell
|
0021| severance tax bonds in compliance with the Severance Tax Bonding
|
0022| Act in an amount not to exceed the total of the amounts
|
0023| authorized for purposes specified in Sections 2 through 5 of
|
0024| this act. The state board of finance shall schedule the
|
0025| issuance and sale of the bonds in the most expeditious and
|
0001| economical manner possible upon a finding by the board that the
|
0002| project has been developed sufficiently to justify the issuance
|
0003| and that the project can proceed to contract within a reasonable
|
0004| time. The state board of finance shall further take the
|
0005| appropriate steps necessary to comply with the Internal Revenue
|
0006| Code of 1986, as amended. Proceeds from the sale of the bonds
|
0007| are appropriated for expenditure for projects in the city of
|
0008| Clovis in Curry county for the purposes specified in Sections 2
|
0009| through 5 of this act.
|
0010| B. The agencies named in Sections 2 through 5 of
|
0011| this act shall certify to the state board of finance when the
|
0012| money from the proceeds of the severance tax bonds authorized in
|
0013| this section is needed for the purposes specified in the
|
0014| applicable section of this act.
|
0015| C. If the specified agency has not certified the
|
0016| need for the issuance of the bonds by the end of fiscal year
|
0017| 1998, the authorization provided in this act shall be void.
|
0018| D. Unless otherwise specified in this act, any
|
0019| unexpended or unencumbered balance remaining from the proceeds
|
0020| of severance tax bonds issued pursuant to Sections 2 through 5
|
0021| of this act at the end of fiscal year 1999 shall revert to the
|
0022| severance tax bonding fund.
|
0023| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF
|
0024| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1
|
0025| of this act, upon certification by the department of environment
|
0001| that the need exists for the issuance of the bonds, four million
|
0002| two hundred thousand dollars ($4,200,000) is appropriated to the
|
0003| department of environment in the following amounts for the
|
0004| following purposes:
|
0005| A. six hundred thousand dollars ($600,000) for a
|
0006| wastewater sludge composting facility in Curry county; and
|
0007| B. three million six hundred thousand dollars
|
0008| ($3,600,000) for planning, designing or constructing a two-million gallons per day expansion of the wastewater treatment
|
0009| facility in Curry county.
|
0010| Section 3. SEVERANCE TAX BONDS--STATE HIGHWAY AND
|
0011| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the provisions
|
0012| of Section 1 of this act, upon certification by the state
|
0013| highway and transportation department that the need exists for
|
0014| the issuance of the bonds, two million eight hundred thousand
|
0015| dollars ($2,800,000) is appropriated to the state highway and
|
0016| transportation department in the following amounts for the
|
0017| following purposes:
|
0018| A. one million seven hundred thousand dollars
|
0019| ($1,700,000) for phase III reconstruction of west Seventh street
|
0020| from Tharp to Bonita streets, including street lighting,
|
0021| sidewalks and drainage systems in Curry county;
|
0022| B. two hundred fifty thousand dollars ($250,000) for
|
0023| reconstruction and widening of Twenty-first street from Gerry to
|
0024| Thomas streets in Curry county;
|
0025| C. one hundred thousand dollars ($100,000) for
|
0001| street and drainage improvements to Echols street at the Liebelt
|
0002| ditch in Curry county;
|
0003| D. three hundred fifty thousand dollars ($350,000)
|
0004| to reconstruct and widen east Seventh street from Norris to
|
0005| Humphrey streets in Curry county; and
|
0006| E. four hundred thousand dollars ($400,000) to
|
0007| reconstruct and widen Thomas street from Riata to Llano Estacado
|
0008| in Curry county.
|
0009| Section 4. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0010| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section
|
0011| 1 of this act, upon certification by the local government
|
0012| division of the department of finance and administration that
|
0013| the need exists for the issuance of the bonds, four million nine
|
0014| hundred eighty-eight thousand dollars ($4,988,000) is
|
0015| appropriated to the local government division of the department
|
0016| of finance and administration in the following amounts for the
|
0017| following purposes:
|
0018| A. one hundred fifty thousand dollars ($150,000) for
|
0019| purchase and installation of playground equipment in various
|
0020| municipal parks in Curry county;
|
0021| B. one hundred thousand dollars ($100,000) to plan,
|
0022| design or construct a maintenance shop and storage facility for
|
0023| the municipal parks division in Curry county;
|
0024| C. forty thousand dollars ($40,000) to replace the
|
0025| gymnasium floor at the Roy Walker center in Curry county;
|
0001| D. one hundred thousand dollars ($100,000) for
|
0002| purchase and installation of equipment and playground systems
|
0003| for the Ned Houk park in Curry county;
|
0004| E. seventy thousand dollars ($70,000) for median
|
0005| beautification on various municipal streets in Curry county;
|
0006| F. twenty-eight thousand dollars ($28,000) to plan,
|
0007| design or construct a reptile exhibit facility at the municipal
|
0008| zoo in Curry county; and
|
0009| G. four million five hundred thousand dollars
|
0010| ($4,500,000) to plan, design or construct a municipal convention
|
0011| and civic center facility in Curry county.
|
0012| Section 5. SEVERANCE TAX BONDS--CLOVIS COMMUNITY COLLEGE
|
0013| GOVERNING BOARD--PURPOSE.--Pursuant to the provisions of Section
|
0014| 1 of this act, upon certification by the governing board of
|
0015| Clovis community college in that the need exists for the
|
0016| issuance of the bonds, one million one hundred thousand dollars
|
0017| ($1,100,000) is appropriated to the governing board of Clovis
|
0018| community college in Curry county for the purpose of planning,
|
0019| designing or constructing a new classroom addition and
|
0020| renovation of the college library.
|
0021| Section 6. EMERGENCY.--It is necessary for the public
|
0022| peace, health and safety that this act take effect immediately.
