PASTER | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO CRIMINAL AND JUVENILE JUSTICE; MANDATING A STUDY | 0013| REGARDING THE USE OF A PROPOSED SECURE JUVENILE DETENTION | 0014| FACILITY; REPEALING AND ENACTING A NEW SECTION OF THE NMSA 1978; | 0015| MAKING AN APPROPRIATION. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. A new Section 9-3-10.3 NMSA 1978 is enacted to | 0019| read: | 0020| "9-3-10.3. [NEW MATERIAL] STUDY OF SECURE JUVENILE | 0021| DETENTION FACILITY--DUTIES.-- | 0022| A. In addition to its other duties set forth in | 0023| Section 9-3-10 NMSA 1978, the criminal and juvenile justice | 0024| coordinating council shall assist the children, youth and | 0025| families department with development of recommendations for the | 0001| design and use of a secure juvenile detention facility. During | 0002| the study, the council shall consider: | 0003| (1) the type of facility needed for adequate | 0004| protection of the public; | 0005| (2) which children, up to twenty-one years of | 0006| age, require secure detention; | 0007| (3) which children can achieve reasonable | 0008| rehabilitation by the use of procedures, services and facilities | 0009| currently available; | 0010| (4) whether the seriousness of a criminal | 0011| offense requires secure detention, including the need for secure | 0012| detention if the criminal offense was committed in an | 0013| aggressive, violent, premeditated or willful manner; | 0014| (5) the need for secure detention if the | 0015| criminal offense was committed during a transaction or | 0016| occurrence that involved gang activity or the use of a firearm; | 0017| and | 0018| (6) the need for secure detention if the | 0019| criminal offense was committed against a person or property, and | 0020| if against a person, whether personal injury resulted. | 0021| B. The council shall make recommendations about the | 0022| sophistication and maturity of a child requiring secure | 0023| detention, taking into account the child's home, environmental | 0024| situation, emotional attitude and pattern of living and the | 0025| record and previous history of the child. | 0001| C. The council shall recommend: | 0002| (1) whether a child who receives an adult | 0003| sentence should be committed to the jurisdiction of the | 0004| children, youth and families department for placement in a | 0005| secure juvenile detention facility until twenty-one years of age | 0006| or committed to the jurisdiction of the corrections department; | 0007| (2) whether children thirteen and fourteen | 0008| years of age should be subject to adult sentencing and placement | 0009| in a secure juvenile detention facility; and | 0010| (3) statutory changes needed to provide the | 0011| children, youth and families department and the courts with | 0012| express authority to place a child in a secure juvenile | 0013| detention facility. | 0014| D. The council shall conclude its study of secure | 0015| juvenile detention issues and provide a written report of its | 0016| findings and recommendations to an interim legislative committee | 0017| with jurisdiction over juvenile justice issues no later than | 0018| October 1, 1996." | 0019| Section 2. DELAYED REPEAL.--Section 9-3-10.3 NMSA 1978 | 0020| (being Section 1 of this act) is repealed effective January 1, | 0021| 1997. | 0022| Section 3. APPROPRIATION.--Twenty-five thousand dollars | 0023| ($25,000) is appropriated from the general fund to the criminal | 0024| and juvenile justice coordinating council for expenditure in | 0025| fiscal year 1997 for the purpose of conducting a study of a | 0001| secure juvenile detention facility. The council shall consider: | 0009| (1) the design of a secure juvenile facility | 0010| needed for adequate protection of the public; | 0011| (2) criteria for determining which children, up | 0012| to twenty-one years of age, require a secure juvenile facility; | 0013| (3) criteria for determining which children can | 0014| achieve reasonable rehabilitation by the use of procedures, | 0015| services and facilities currently available; | 0016| (4) whether the seriousness of a criminal offense | 0017| alone requires secure confinement, including the need for a | 0018| secure juvenile facility if the criminal offense was committed | 0019| in an aggressive, violent, premeditated or willful manner; | 0020| (5) the need for secure confinement if the | 0021| criminal offense was committed during a transaction or | 0022| occurrence that involved criminal gang activity or the use of a | 0023| firearm; and | 0024| (6) the need for secure confinement if the | 0025| criminal offense was committed against a person or property, and | 0001| if against a person, whether personal injury resulted. | 0002| B. The council shall advise the children, youth and | 0003| families department on the development of a classification | 0004| system to indicate when children require secure confinement, | 0005| taking into account the child's home, environmental situation, | 0006| emotional attitude and pattern of living and the record and | 0007| previous history of the child. | 0008| C. The council shall advise the children, youth and | 0009| families department and the corrections department on the | 0010| development of criteria regarding: | 0011| (1) whether children who receive adult sentences | 0012| should be committed to the jurisdiction of the children, youth and | 0013| families department for placement in a secure juvenile facility | 0014| until twenty-one years of age or committed to the jurisdiction of | 0015| the corrections department; | 0016| (2) whether children thirteen and fourteen years of | 0017| age who are subject to adult sentencing should be placed in a | 0018| secure juvenile facility; and | 0019| (3) statutory changes needed, if any, to provide the | 0020| children, youth and families department and the courts with express | 0021| authority to place children in a secure juvenile facility. | 0022| D. The council shall conclude its review of issues | 0023| attendant to a proposed secure juvenile facility and provide a | 0024| written report of its findings and recommendations to the children, | 0025| youth and families department, the corrections department and an | 0001| interim legislative committee with jurisdiction over juvenile | 0002| justice issues no later than October 1, 1996." | 0003| Section 2.
