JENNINGS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO TOURISM; ABOLISHING THE TOURISM DEPARTMENT; | 0013| TRANSFERRING DUTIES OF THE TOURISM DEPARTMENT TO THE ECONOMIC | 0014| DEVELOPMENT DEPARTMENT; AMENDING, REPEALING AND ENACTING | 0015| SECTIONS OF THE NMSA 1978. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. A new section of the Economic Development | 0019| Department Act is enacted to read: | 0020| "[NEW MATERIAL] ADDITIONAL DUTIES OF SECRETARY--PROMOTION OF TOURISM.--In addition to the secretary's | 0021| responsibility for the overall supervision of the department, | 0022| the secretary shall provide a coordinated statewide perspective | 0023| with regard to tourism activities; serve as a comprehensive | 0024| source of information and assistance to tourism-related | 0025| businesses wishing to do business in New Mexico; and monitor the | 0001| progress of state-supported tourism activities and prepare | 0002| annual reports of the activities, their status and their | 0003| impact." | 0004| Section 2. Section 9-15-4 NMSA 1978 (being Laws 1983, | 0005| Chapter 297, Section 4, as amended) is amended to read: | 0006| "9-15-4. DEPARTMENT ESTABLISHED.--There is created in the | 0007| executive branch the "economic development department". The | 0008| department shall be a cabinet department and shall consist of, | 0009| but not be limited to, [seven] eight divisions as follows: | 0010| A. the administrative services division; | 0011| B. the economic development division; | 0012| C. the New Mexico film division; | 0013| D. the technology enterprise division; | 0014| E. the trade division; | 0015| F. the tourism division; | 0016| [F.] G. the state housing authority; and | 0017| [G.] H. the office for space commercialization." | 0018| Section 3. Section 9-15-35 NMSA 1978 (being Laws 1991, | 0019| Chapter 27, Section 1) is amended to read: | 0020| "9-15-35. PROGRAM CREATED--PURPOSES.-- | 0021| A. The "New Mexico artisans business development | 0022| program" is created within the economic development [and | 0023| tourism] department to promote, in conjunction with the arts | 0024| division of the office of cultural affairs, the New Mexico | 0025| artisans industry by establishing a greater demand for New | 0001| Mexico artisans' wares and by providing technical and marketing | 0002| assistance to New Mexico artisans. | 0003| B. The purposes of the program shall include but not | 0004| be limited to the following: | 0005| (1) establishment of a not-for-profit | 0006| organization to carry out the objectives of the New Mexico | 0007| artisans business development program; | 0008| (2) educational workshops and seminars in | 0009| cooperation with the small business development centers for | 0010| artisans to assist the centers in the development of their | 0011| businesses and marketing of their wares; | 0012| (3) an assessment of a full range of marketing | 0013| strategies for artisan wares and relating those wares to target | 0014| markets; | 0015| (4) production of a promotional brochure of New | 0016| Mexico artisans and their products; | 0017| (5) development and publishing of a marketing | 0018| catalog of New Mexico artisans; | 0019| (6) establishment of a network of state and | 0020| national distribution points and gift and trade shows for the | 0021| promotion and export of New Mexico artisans' wares; | 0022| (7) development of a state and national | 0023| marketing and exhibitions calendar; | 0024| (8) participation in state and national | 0025| promotional shows by New Mexico artisans; and | 0001| (9) development of a marketing network with | 0002| private-sector distributors, catalog producers and retailers." | 0003| Section 4. Section 9-15-36 NMSA 1978 (being Laws 1991, | 0004| Chapter 27, Section 2) is amended to read: | 0005| "9-15-36. FUND CREATED.--There is created in the state | 0006| treasury the "New Mexico artisans business development fund". | 0007| The fund shall consist of money appropriated to the fund by the | 0008| legislature and any other revenues directed to the fund, such as | 0009| gifts, donations and grants. The fund shall be administered by | 0010| the economic development [and tourism] department and | 0011| expenditures may be made from the fund upon vouchers signed by | 0012| the secretary of economic development [and tourism] and | 0013| warrants issued by the secretary of finance and administration | 0014| for the purposes of the New Mexico artisans business development | 0015| program. Interest earned on balances in the fund shall be | 0016| credited to the fund." | 0017| Section 5. Section 16-6-5 NMSA 1978 (being Laws 1977, | 0018| Chapter 245, Section 18, as amended) is amended to read: | 0019| "16-6-5. STATE FAIR COMMISSION ADMINISTRATIVELY ATTACHED | 0020| TO [TOURISM] ECONOMIC DEVELOPMENT DEPARTMENT.--The state | 0021| fair commission is administratively attached, as defined in the | 0022| Executive Reorganization Act, to the [tourism] economic | 0023| development department." | 0024| Section 6. Section 21-2-6 NMSA 1978 (being Laws 1978, | 0025| Chapter 54, Section 1, as amended) is amended to read: | 0001| "21-2-6. STATEWIDE PLANNING--PARTICIPATING AGENCIES AND | 0002| PERSONS.-- | 0003| A. The state commission in carrying out its planning | 0004| activities for post-secondary education shall consult with and | 0005| invite the active participation of: | 0006| (1) representatives of post-secondary | 0007| educational institutions of the several types enumerated in | 0008| Paragraph (2) of Subsection A of Section 21-2-2 NMSA 1978; | 0009| (2) the state board of education; | 0010| (3) the state department of public education; | 0011| (4) representatives of public and private | 0012| elementary and secondary schools; | 0013| (5) the secretary of labor; | 0014| [(6) the tourism department; | 0015| (7)] (6) the apprenticeship council; | 0016| [(8)] (7) the economic development | 0017| department; | 0018| [(9)] (8) the state advisory council on | 0019| vocational education; | 0020| [(10)] (9) the secretary of finance and | 0021| administration or his designee; | 0022| [(11)] (10) persons familiar with the | 0023| education needs of the disadvantaged, of the handicapped and of | 0024| minority groups; | 0025| [(12)] (11) representatives of business, | 0001| industry, organized labor and agriculture; | 0002| [(13)] (12) the general public; and | 0003| [(14)] (13) private in-state post-secondary | 0004| institutions. | 0005| B. Whenever the planning activities carried out | 0006| under the provisions of Section 21-2-5 NMSA 1978 are concerned | 0007| with the types of post-secondary education enumerated in | 0008| Subparagraphs (a) through (e) of Paragraph (1) of Subsection A | 0009| of Section 21-2-2 NMSA 1978, the state commission shall directly | 0010| involve the state board of education and the state department of | 0011| public education in all planning activities." | 0012| Section 7. Section 21-19-10 NMSA 1978 (being Laws 1983, | 0013| Chapter 299, Section 4, as amended) is amended to read: | 0014| "21-19-10. COMMUNITY DEVELOPMENT ASSISTANCE.--The economic | 0015| development department shall provide assistance to political | 0016| subdivisions of the state so that they can construct or | 0017| implement projects necessary to provide services that will | 0018| encourage the location of industry in the political | 0019| subdivisions. The department shall, for this purpose, make low-interest loans to political subdivisions of the state [with the | 0020| approval of the economic development and tourism commission | 0021| and] after coordination with the local government division of | 0022| the department of finance and administration pursuant to the New | 0023| Mexico Community Assistance Act." | 0024| Section 8. Section 60-1-2 NMSA 1978 (being Laws 1977, | 0025| Chapter 245, Section 123, as amended) is amended to read: | 0001| "60-1-2. STATE RACING COMMISSION ADMINISTRATIVELY ATTACHED | 0002| TO [TOURISM] ECONOMIC DEVELOPMENT DEPARTMENT.--The state | 0003| racing commission is administratively attached, as defined in | 0004| the Executive Reorganization Act, to the [tourism] economic | 0005| development department." | 0006| Section 9. Section 73-23-3 NMSA 1978 (being Laws 1985 (1st | 0007| S.S.), Chapter 14, Section 3, as amended) is amended to read: | 0008| "73-23-3. CREATION OF STATE TRANSPORTATION AUTHORITY--MEMBERS--COMPENSATION--ORGANIZATION.-- | 0009| A. There is created the "state transportation | 0010| authority", a body politic and corporate, subject to the | 0011| oversight of the legislature, consisting of the following | 0012| members: | 0013| (1) the secretary of highway and transportation | 0014| or his designee; | 0015| (2) the secretary of economic development or | 0016| his designee; | 0017| (3) the commissioner of public lands or his | 0018| designee; | 0019| (4) [the secretary of tourism or his designee; | 0020| (5)] the secretary of energy, minerals and | 0021| natural resources or his designee; | 0022| [(6)] (5) the secretary of environment or | 0023| his designee; | 0024| [(7)] (6) one Native American | 0025| representative appointed by the governor with the advice and | 0001| consent of the senate; | 0002| [(8)] (7) two representatives of the | 0003| transportation and mining industries appointed by the governor | 0004| with the advice and consent of the senate; and | 0005| [(9)] (8) three representatives of the | 0006| public at large, at least one of whom shall represent a | 0007| recognized environmental group, appointed by the governor with | 0008| the advice and consent of the senate. | 0009| B. The members of the state transportation authority | 0010| appointed by the governor shall serve for five-year terms. Any | 0011| vacancy occurring in the governor's appointed membership of the | 0012| authority shall be filled by appointment by the governor for the | 0013| unexpired term of the member. Members serving by virtue of | 0014| their offices shall serve terms coextensive with their terms in | 0015| that office, and their successors in office shall automatically | 0016| succeed them. | 0017| C. The members of the state transportation authority | 0018| shall elect a chairman and a secretary. | 0019| D. Actions of the state transportation authority | 0020| shall be taken only by a majority of the entire membership. | 0021| E. The state highway and transportation department, | 0022| the economic development department, the state land office, the | 0023| department of environment, [the tourism department] the | 0024| energy, minerals and natural resources department and other | 0025| executive departments of the state shall provide adequate staff | 0001| for the state transportation authority to carry out its duties. | 0002| F. The state transportation authority shall meet | 0003| quarterly and at such other times as the chairman may designate. | 0004| G. The attorney general's office shall provide legal | 0005| advice to the state transportation authority when requested. | 0006| H. The appointed members of the state transportation | 0007| authority shall receive compensation for their services as | 0008| provided in the Per Diem and Mileage Act." | 0009| Section 10. TEMPORARY PROVISION.--On July 1, 1996: | 0010| A. all personnel, money, appropriations, records, | 0011| property, equipment and supplies of the tourism department shall | 0012| be transferred to the economic development department; and | 0013| B. all contracts and agreements of the tourism | 0014| department shall be binding and effective on the economic | 0015| development department. | 0016| Section 11. REPEAL.--Sections 9-15A-1 through 9-15A-9 NMSA | 0017| 1978 (being Laws 1991, Chapter 21, Sections 1 through 7 and Laws | 0018| 1993, Chapter 101, Sections 10 and 11, as amended) are repealed. | 0019| Section 12.
