0012|     RELATING TO EDUCATION; AMENDING SECTION 21-1-3 NMSA 1978 (BEING

0013|     LAWS 1970, CHAPTER 47, SECTION 1, AS AMENDED) TO PROVIDE FOR

0014|     RESIDENT TUITION FOR NONRESIDENTS LIVING WITHIN SEVENTY-FIVE
    |
0015|     MILES OF THE NEW MEXICO BORDER IN STATES THAT RECIPROCATE FOR
    |
0016|     NEW MEXICO STUDENTS.

0018|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0019|       Section 1.  Section 21-1-3 NMSA 1978 (being Laws 1970,
    |
0020|     Chapter 47, Section 1, as amended) is amended to read:

    |
0021|       "21-1-3.  STATE EDUCATIONAL INSTITUTIONS--RESIDENT
    |
0022|     STUDENTS.--
    |
0023|            A.  For the purpose of tuition payment at the
    |
0024|     resident student rates at state educational institutions, as
    |
0025|     defined in Article 12, Section 11 of the constitution of New
    |
0001|     Mexico, "resident student" includes:
    |
0002|                 (1)  any person not otherwise entitled to claim
    |
0003|     residence who is a member of the armed forces of the United
    |
0004|     States assigned to active duty within the exterior boundaries of
    |
0005|     this state; and
    |
0006|                 (2)  the spouse or dependent child of any person
    |
0007|     who qualifies under Paragraph (1) of this subsection.
    |
0008|            B.  Assignment to active duty within the exterior
    |
0009|     boundaries of this state may be established by a certificate of
    |
0010|     assignment from the commanding officer of the person so
    |
0011|     assigned.
    |
0012|            C.  For the purpose of tuition payment at resident
    |
0013|     student rates at New Mexico highlands university, "resident
    |
0014|     student" may include any person who is a Native American and a
    |
0015|     citizen of the United States.
    |
0016|            <u>D.  "Resident student" includes any student who
</u>    |
<u></u>0017| <u>    resides within seventy-five miles of the New Mexico border in an
</u>    |
<u></u>0018| <u>    adjacent state that provides reciprocity for New Mexico
</u>    |
<u></u>0019| <u>    students</u>."

0002|   includes any Texas resident who resides within a one hundred thirty-five
