CAPITAL PROGRAM FUND--CHANGE IN AGENCY--CONTINUED AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The capital program fund appropriation, pursuant to Paragraph | 0020| (2) of Subsection U of Section 2 of Chapter 6 of Laws 1990 (1st | 0021| S.S.), for the construction of a home for homeless children | 0022| shall be appropriated to the local government division of the | 0023| department of finance and administration to plan, design, | 0024| construct and furnish a home for homeless children in | 0025| Albuquerque located in Bernalillo county, provided that the city | 0001| of Albuquerque receives a donation from a private or public | 0002| organization of a minimum of ten acres of land for constructing | 0003| the home and that the city of Albuquerque, through its child | 0004| development office, executes a contract with an organization | 0005| that provides services to homeless children for the operation of | 0006| the home for a minimum of ten years. Notwithstanding the | 0007| provisions of Laws 1995, Chapter 218, Section 27, any unexpended | 0008| or unencumbered balance remaining at the end of fiscal year 1999 | 0009| shall revert to the capital program fund. | 0010| Section 2. SEVERANCE TAX BONDS--CHANGE IN AGENCY--CONTINUED AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The balance of the proceeds from severance tax bonds | 0011| appropriated to the general services department, pursuant to | 0012| Laws 1992, Chapter 113, Section 20, for the New Day shelter for | 0013| troubled youth in Albuquerque located in Bernalillo county shall | 0014| not be expended by that agency nor be subject to the contingency | 0015| imposed but is reauthorized and appropriated to the local | 0016| government division of the department of finance and | 0017| administration and shall be contingent upon the city of | 0018| Albuquerque receiving a donation from a private or public | 0019| organization of a minimum of ten acres of land for building the | 0020| home, and the city of Albuquerque, through its child development | 0021| office, executing a contract with an organization that provides | 0022| services to children for the operation of the home for a minimum | 0023| of ten years. Notwithstanding the provisions of Laws 1995, | 0024| Chapter 218, Section 27, any unexpended or unencumbered balance | 0025| remaining at the end of fiscal year 1999 shall revert to the | 0001| severance tax bonding fund. | 0002| Section 3.
