0001| SENATE BILL 806 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND SESSION, | 0003| 1996 | 0004| INTRODUCED BY | 0005| JOHN ARTHUR SMITH | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO GAMING; ESTABLISHING A TASK FORCE TO NEGOTIATE | 0013| INTERGOVERNMENTAL JOINT GAMING AGREEMENTS; ESTABLISHING | 0014| NEGOTIATING CRITERIA; DECLARING A MORATORIUM; MAKING AN | 0015| APPROPRIATION; DECLARING AN EMERGENCY. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. TASK FORCE CREATED--MEMBERSHIP--DURATION.-- | 0019| A. The "intergovernmental gaming task force" is | 0020| created. | 0021| B. The intergovernmental gaming task force shall be | 0022| composed of eighteen members appointed or selected in the | 0023| following manner: | 0024| (1) three members shall be appointed by the | 0025| president pro tempore of the senate from the members of the | 0001| senate, one of whom shall be Native American and one of whom | 0002| shall be from the minority party after consultation with the | 0003| minority floor leader; | 0004| (2) three members shall be appointed by the | 0005| speaker of the house of representatives from the membership of | 0006| the house of representatives, one of whom shall be Native | 0007| American and one of whom shall be from the minority party, | 0008| appointed after consultation with the minority floor leader; | 0009| (3) six members shall be appointed by the | 0010| governor; and | 0011| (4) six members shall be appointed from among | 0012| the gaming tribes by tribal consensus of those tribes. | 0013| C. The intergovernmental agency task force shall | 0014| cease to exist on January 1, 1997. | 0015| Section 2. TASK FORCE--PURPOSE--DUTIES--STAFFING.-- | 0016| A. The purpose of the intergovernmental gaming task | 0017| force is to develop a plan for a joint venture between the | 0018| gaming tribes of New Mexico and the state in which regulation, | 0019| operation and profits of gaming are shared between the tribes | 0020| and the state. | 0021| B. The intergovernmental gaming task force shall | 0022| consider: | 0023| (1) how a joint venture might be structured; | 0024| (2) how the profits are to be divided between | 0025| the state and the tribes seeking an equal distribution of | 0001| profits between the state and the tribes and a formula for | 0002| distribution that is acceptable and equitable; | 0003| (3) where jointly operated gaming | 0004| establishments would be located; | 0005| (4) cooperative security and regulatory | 0006| structures; | 0007| (5) distribution of costs for security and | 0008| regulation; | 0009| (6) a system to provide for infrastructure | 0010| development for all of the tribes in New Mexico; and | 0011| (7) any other matter that would enable the | 0012| state and the gaming tribes to successfully cooperate in the | 0013| operation, regulation and proceeds of gaming in New Mexico. | 0014| D. The intergovernmental gaming task force shall | 0015| report its findings to the first session of the forty-third | 0016| legislature and prepare all legislation necessary to implement | 0017| the findings of the task force. | 0018| E. The staff for the intergovernmental gaming task | 0019| force shall be provided by the legislative council service. | 0020| F. The nonlegislative members of the | 0021| intergovernmental gaming task force shall be paid per diem and | 0022| mileage at the same rate as the legislative members. | 0023| Section 3. MORATORIUM ON ENFORCEMENT OF GAMING OCCURRING | 0024| IN STATE.--Gaming on video pull tab machines shall be permitted | 0025| to occur in New Mexico under the regulation of the alcohol and | 0001| gaming division of the regulation and licensing department at | 0002| organizations exempt from federal income tax pursuant to Section | 0003| 501(a) of the Internal Revenue Code of 1986, as amended and | 0004| described in Section 501(c)(3), (8), (10), (19) or (23) of that | 0005| code if the organization is also licensed pursuant to the Bingo | 0006| and Raffle Act. The state or any agency or agent of the state | 0007| shall take no action to interfere with the operation of tribal | 0008| gaming establishments in New Mexico that are on lands of tribes | 0009| that have entered into tribal-state gaming compacts that have | 0010| been signed by the secretary of the interior and have been | 0011| published in the federal register until March 30, 1997. | 0012| Section 4. APPROPRIATION.--Fifty thousand dollars | 0013| ($50,000) is appropriated from the general fund to the | 0014| legislative council service for expenditure in fiscal year 1997 | 0015| for the purpose of providing support staff for and otherwise | 0016| funding deliberations of the intergovernmental gaming task | 0017| force. Any unexpended or unencumbered balance remaining at the | 0018| end of fiscal year 1997 shall revert to the general fund. | 0019| Section 5.
