0001| HOUSE JOINT MEMORIAL 10 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND | 0003| SESSION, 1996 | 0004| INTRODUCED BY | 0005| JAMES ROGER MADALENA | 0006| | 0007| | 0008| | 0009| FOR THE HEALTH CARE TASK FORCE | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THAT THE LEGISLATIVE AND EXECUTIVE BRANCHES OF THE | 0013| STATE OF NEW MEXICO RECOGNIZE INDIAN TRIBES, PUEBLOS AND NATIONS | 0014| AS EQUIVALENT TO STATES TO OBTAIN DIRECT PASS-THROUGH OF FEDERAL | 0015| BLOCK GRANT FUNDING FOR THE MEDICAID PROGRAM. | 0016| | 0017| WHEREAS, the federal government is expected to make major | 0018| structural changes to the medicaid program; and | 0019| WHEREAS, the federal government may give block grants to | 0020| states in a specified amount to design their own approaches to | 0021| the medicaid program; and | 0022| WHEREAS, historically federal block grants have been given | 0023| directly to state executive agencies with jurisdiction for | 0024| administration of the grants; and | 0025| WHEREAS, the federal government has a unique legal | 0001| relationship with American Indian tribal governments as set | 0002| | 0003| forth in the constitution of the United States, treaties, | 0004| statutes and court decisions; and | 0005| WHEREAS, as federal and New Mexico state executive agencies | 0006| and the New Mexico state legislature undertake activities that | 0007| may affect American Indian tribal rights or resources, these | 0008| activities should be implemented in a knowledgeable and | 0009| sensitive manner respectful of tribal sovereignty; and | 0010| WHEREAS, federal block grant initiatives have generally | 0011| focused on states receiving and controlling funds and services, | 0012| neglecting to consider the role of tribal governments in | 0013| providing services to tribal members and others who benefit from | 0014| the programs; and | 0015| WHEREAS, if the federal block grant initiatives do not | 0016| address the unique tribal-federal relationship, they may | 0017| significantly alter the expressed federal policy of respecting | 0018| the government-to-government relationship with Indian tribes, | 0019| pueblos and nations and therefore undermine long-standing, | 0020| treaty-based, federal policy; and | 0021| WHEREAS, if the federal government offers the federal block | 0022| grant for the medicaid program only to the state, then the | 0023| Indian tribes, pueblos and nations may not be considered as a | 0024| priority within the state; thus they might receive less funds | 0025| and be unable to meet the needs of tribal citizens; | 0001| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0002| STATE OF NEW MEXICO that if Indian tribes, pueblos and nations | 0003| | 0004| in New Mexico so request they should be treated as the | 0005| equivalent of states to obtain federal block grant funding so | 0006| they may maintain sovereignty and define eligibility criteria or | 0007| requirements for the medicaid program; and | 0008| BE IT FURTHER RESOLVED that the New Mexico state | 0009| legislature support a direct pass-through of federal block grant | 0010| funding to Indian tribes, pueblos and nations if that is what | 0011| they request; and | 0012| BE IT FURTHER RESOLVED that any federal block grant | 0013| initiatives from the federal government to New Mexico regarding | 0014| the medicaid program consider the role of tribal governments in | 0015| providing services to tribal members and address the unique | 0016| tribal-federal relationship expressed in federal trust | 0017| responsibilities, sovereignty and the government-to-government | 0018| relationships between Indian tribes, pueblos and nations and the | 0019| federal government; and | 0020| BE IT FURTHER RESOLVED that copies of this memorial be | 0021| transmitted to the New Mexico congressional delegation; to the | 0022| governor for distribution to the appropriate state agencies and | 0023| institutions; to each of the Indian tribes, pueblos and nations | 0024| in New Mexico; and to the legislative council service for | 0025| distribution to the appropriate interim committees. | 0001| - 3 - | 0002| | 0003| | 0004| State of New Mexico | 0005| House of Representatives | 0006| | 0007| FORTY-SECOND LEGISLATURE | 0008| SECOND SESSION, 1996 | 0009| | 0010| January 25, l996 | 0011| | 0012| | 0013| Mr. Speaker: | 0014| | 0015| Your RULES AND ORDER OF BUSINESS COMMITTEE, to | 0016| whom has been referred | 0017| | 0018| HOUSE JOINT MEMORIAL 10 | 0019| | 0020| has had it under consideration and finds same to be | 0021| GERMANE in accordance with constitutional provisions. | 0022| | 0023| Respectfully submitted, | 0024| | 0025| | 0001| | 0002| | 0003| Barbara A.
