0001| HOUSE JOINT MEMORIAL 11 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND | 0003| SESSION, 1996 | 0004| INTRODUCED BY | 0005| CISCO MCSORLEY | 0006| | 0007| | 0008| | 0009| FOR THE COURTS, CORRECTIONS AND CRIMINAL JUSTICE COMMITTEE | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THAT THE CORRECTIONS DEPARTMENT ADOPT PROCEDURES AND | 0013| REGULATIONS TO ENSURE THAT VIOLENT FELONS SERVE A SUBSTANTIAL | 0014| PORTION OF THEIR SENTENCES. | 0015| | 0016| WHEREAS, during the 1995 legislative session, the | 0017| legislature enacted House Judiciary Committee Substitute for | 0018| House Bills 30, 169, 202 and 640, as amended, which provided | 0019| that violent felony offenders would be required to serve greater | 0020| proportions of their sentences and that the most violent felons | 0021| would be required to serve not less than eighty-five percent of | 0022| their sentences; and | 0023| WHEREAS, the governor elected to veto House Judiciary | 0024| Committee Substitute for House Bills 30, 169, 202 and 640, as | 0025| amended; and | 0001| WHEREAS, the public safety concerns of the citizens of New | 0002| Mexico would have been addressed in part by the legislative | 0003| proposal to require violent felons to serve a greater proportion | 0004| of their sentences; and | 0005| WHEREAS, the federal Violent Crime Control and Law | 0006| Enforcement Act of 1994 provides funding for construction of | 0007| state prisons to states that give assurances that they have | 0008| implemented or will implement policies to ensure that violent | 0009| offenders serve a substantial portion of the sentences imposed | 0010| upon them; and | 0011| WHEREAS, in light of the governor's veto of House Judiciary | 0012| Committee Substitute for House Bills 30, 169, 202 and 640, as | 0013| amended, the state's eligibility for federal money to fund | 0014| construction of new prisons is in doubt at a time when the state | 0015| is proceeding with plans to construct two new prisons in | 0016| Guadalupe and Lea counties, respectively; | 0017| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0018| STATE OF NEW MEXICO that the corrections department adopt | 0019| procedures and regulations to ensure that violent felons serve a | 0020| substantial portion of their sentences; and | 0021| BE IT FURTHER RESOLVED that the corrections department | 0022| provide testimony to an interim committee with jurisdiction over | 0023| corrections issues regarding adoption of the aforementioned | 0024| procedures and regulations no later than October 31, 1996; and | 0025| BE IT FURTHER RESOLVED that a copy of this memorial be | 0001| transmitted to the governor, the secretary of corrections and | 0002| the secretary of finance and administration. | 0003| - 3- | 0004| | 0005| | 0006| HJM 1 State of New Mexico | 0007| House of Representatives | 0008| | 0009| FORTY-SECOND LEGISLATURE | 0010| SECOND SESSION, 1996 | 0011| | 0012| January 30, 1996 | 0013| | 0014| | 0015| Mr. Speaker: | 0016| | 0017| Your RULES AND ORDER OF BUSINESS COMMITTEE has | 0018| approved the following certificate of congratulations: | 0019| | 0020| CERTIFICATE # 1 to THE PEOPLE OF NEW MEXICO | 0021| CELEBRATING "RANDOM ACTS OF KINDNESS WEEK" | 0022| | 0023| and directs the chief clerk to prepare suitable documents to | 0024| express the congratulations of the house of representatives. | 0025| | 0001| Respectfully submitted, | 0002| | 0003| | 0004| | 0005| Barbara A.
