0012|     REQUESTING THE STUDY AND REVISION OF THE NEW MEXICO STATUTES
    |
0013|     RELATING TO THE MENTALLY ILL.
    |

    |
0015|       WHEREAS, there is a substantial lack of public knowledge
    |
0016|     about legal issues around mental illness and the effects of
    |
0017|     other brain diseases; and
    |
0018|       WHEREAS, statutory revision is far behind current medical
    |
0019|     and scientific knowledge about mental illness; and
    |
0020|       WHEREAS, due to biological brain disorders some individuals
    |
0021|     lack judgment about their need for medical treatment; and
    |
0022|       WHEREAS, sometimes the judicial system is not able to act
    |
0023|     on commitment issues in a timely manner; and
    |
0024|       WHEREAS, court-ordered treatment should always be
    |
0025|     determined by medical professionals with appropriate
    |
0001|     participation by the individual subject to the order, his family
    |
0002|     and other legitimately interested parties;
    |
0003|       NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0004|     STATE OF NEW MEXICO that the need to revise New Mexico's
    |
0005|     statutes related to mental illness and the mentally ill be
    |
0006|     studied by the department of health and recommendations be made
    |
0007|     to the interim legislative health and human services committee
    |
0008|     at its meeting in October 1996; and
    |
0009|       BE IT FURTHER RESOLVED that statewide organizations for the
    |
0010|     mentally ill, mentally ill individuals, the state bar of New
    |
0011|     Mexico, the New Mexico district attorneys association, the
    |
0012|     office of the attorney general, the public defender department,
    |
0013|     the New Mexico office of Indian affairs, statewide medical
    |
0014|     organizations and statewide psychological organizations be
    |
0015|     invited to participate in the study; and
    |
0016|       BE IT FURTHER RESOLVED that a copy of this memorial be sent
    |
0017|     to each named state agency and that the department of health
    |
0018|     invite the participation of the nongovernmental entities
    |
0019|     described.
