WATCHMAN, JR. | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO ASSIGN A REVIEW | 0013| AND REVISION OF THE PAWNBROKERS ACT TO AN APPROPRIATE INTERIM | 0014| COMMITTEE. | 0015| | 0016| WHEREAS, the Pawnbrokers Act was enacted in 1985; and | 0017| WHEREAS, a great deal of confusion exists because of | 0018| conflicts between the Uniform Commercial Code and the wording of | 0019| the Pawnbrokers Act; and | 0020| WHEREAS, there are several areas of regulation that are not | 0021| covered by the provisions of the Pawnbrokers Act; and | 0022| WHEREAS, representatives of the pawnbrokers in the state | 0023| attended hearings during the 1995 legislative session and agreed | 0024| to work with the legislature to revise the Pawnbrokers Act; and | 0025| WHEREAS, investigation and enforcement pursuant to | 0001| provisions of the Pawnbrokers Act are weak and ineffectual; | 0002| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0003| STATE OF NEW MEXICO that the New Mexico legislative council | 0004| assign the review and revision of the Pawnbrokers Act to an | 0005| appropriate interim legislative committee; and | 0006| BE IT FURTHER RESOLVED that the legislature instruct the | 0007| committee to look closely at the practices surrounding pawning | 0008| of vehicles, especially in the northwest quadrant of the state, | 0009| and prepare appropriate legislation to correct shortcomings of | 0010| the Pawnbrokers Act; and | 0011| BE IT FURTHER RESOLVED that copies of this memorial be | 0012| distributed to the members of the New Mexico legislative | 0013| council. | 0014|  State of New Mexico | 0015| House of Representatives | 0016| | 0017| FORTY-SECOND LEGISLATURE | 0018| SECOND SESSION, 1996 | 0019| | 0020| | 0021| February 13, 1996 | 0022| | 0023| | 0024| Mr. Speaker: | 0025| | 0001| Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to | 0002| whom has been referred | 0003| | 0004| HOUSE JOINT MEMORIAL 73 | 0005| | 0006| has had it under consideration and reports same with | 0007| recommendation that it DO PASS. | 0008| | 0009| Respectfully submitted, | 0010| | 0011| | 0012| | 0013| | 0014| Gary K.
