0001| SENATE JOINT MEMORIAL 35 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND | 0003| SESSION, 1996 | 0004| INTRODUCED BY | 0005| TOM RUTHERFORD | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THE HUMAN SERVICES DEPARTMENT TO REDIRECT TWENTY-FIVE | 0013| PERCENT OF MEDICAID EXPENDITURES MONEY NOW USED FOR NURSING HOME | 0014| PAYMENTS TO COMMUNITY-BASED HOME ATTENDANT SERVICES. | 0015| | 0016| WHEREAS, the number of people, old and young, with | 0017| disabilities and in need of long-term care is growing; and | 0018| WHEREAS, historically, society has tended to isolate and | 0019| segregate people with disabilities in institutions; and | 0020| WHEREAS, people, old and young, with disabilities often end | 0021| up in institutions because appropriate community-based home | 0022| attendant services do not exist; and | 0023| WHEREAS, the current long-term care system has an | 0024| institutional bias that inhibits people from living in their | 0025| communities by restricting the use of financial assistance to | 0001| institutional programs; and | 0002| WHEREAS, the current long-term care system is based on | 0003| medical diagnosis and age rather than on functional need; and | 0004| WHEREAS, community-based home attendant services will | 0005| increase the independence of people with disabilities and allow | 0006| them to be active, contributing members of their communities; | 0007| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0008| STATE OF NEW MEXICO that the human services department be | 0009| requested to redirect twenty-five percent of the current | 0010| medicaid (or its successor program) expenditures now used for | 0011| nursing home client payments, to the provision of community-based home attendant client services; and | 0012| BE IT FURTHER RESOLVED that a copy of this memorial be | 0013| transmitted to the secretary of human services. | 0014|  | 0015| | 0016| FORTY-SECOND LEGISLATURE SJM 35/a | 0017| SECOND SESSION, 1996 | 0018| | 0019| | 0020| February 3, 1996 | 0021| | 0022| Mr. President: | 0023| | 0024| Your RULES COMMITTEE, to whom has been referred | 0025| | 0001| SENATE JOINT MEMORIAL 35 | 0002| | 0003| has had it under consideration and reports same with | 0004| recommendation that it DO PASS, amended as follows: | 0005| | 0006| 1.
