STEFANICS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THE DEPARTMENT OF PUBLIC SAFETY, THE TAXATION AND | 0013| REVENUE DEPARTMENT AND THE ATTORNEY GENERAL TO COOPERATE IN A | 0014| STUDY OF TRAFFIC SAFETY LAWS AND THE FINANCIAL RESPONSIBILITY | 0015| AND LIABILITY OF TRAILER PARKS FOR TRAFFIC ACCIDENTS AND | 0016| RESULTING INJURIES ON THEIR PROPERTY AND TO RECOMMEND | 0017| LEGISLATION TO THE APPROPRIATE INTERIM COMMITTEE. | 0018| | 0019| WHEREAS, children have been hit by motorists in trailer | 0020| parks, and because trailer parks are private property, the state | 0021| cannot prosecute drivers, nor can drivers or trailer park owners | 0022| be held financially liable under state law; and | 0023| WHEREAS, trailer parks should not be sanctuaries for | 0024| criminal conduct and reckless driving, and perpetrators of | 0025| lawless behavior should be held accountable, regardless of where | 0001| they have practiced that behavior; | 0002| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0003| STATE OF NEW MEXICO that the department of public safety, the | 0004| taxation and revenue department and the attorney general be | 0005| requested to cooperate in a study of traffic safety laws and | 0006| financial responsibility and liability of trailer parks for | 0007| traffic accidents and resulting injuries on their property and | 0008| recommend legislation to the appropriate interim committee by | 0009| December 1, 1996; and | 0010| BE IT FURTHER RESOLVED that copies of this memorial be | 0011| transmitted to the secretary of public safety, the secretary of | 0012| taxation and revenue and the attorney general. | 0013|  | 0014| | 0015| |
