STEFANICS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THE STATE LAND OFFICE TO NEGOTIATE WITH TORRANCE | 0013| COUNTY FOR PERMANENT EASEMENTS ON ROADS WHERE PROPERTY OWNERS | 0014| HAVE PERFECTED CERTAIN ACCESS RIGHTS OVER TIME THROUGH STATE | 0015| LAND. | 0016| | 0017| WHEREAS, certain property owners and residents of Torrance | 0018| county have used roads across state land to reach their | 0019| property; and | 0020| WHEREAS, the state land office has notified certain | 0021| landowners and residents of Torrance county that it will take | 0022| action to stop continued access; and | 0023| WHEREAS, owners and residents may have legal rights to use | 0024| existing, unimproved roads as access to their property; and | 0025| WHEREAS, the state should seek to avoid legal action | 0001| against it and avoid denial of preexisting rights of access to | 0002| private land; | 0003| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0004| STATE OF NEW MEXICO that the state land office be requested to | 0005| assess the existence of access roads across state land to | 0006| private property and negotiate with property owners and Torrance | 0007| county permanent easements on roads where property owners have | 0008| perfected certain access rights over time through state land; | 0009| and | 0010| BE IT FURTHER RESOLVED that copies of this memorial be | 0011| transmitted to the commissioner of public lands. | 0012|  | 0013| | 0014| |
