0011| RELATING TO THE DWI GRANT COUNCIL; CHANGING THE MEMBERSHIP OF
|
0012| THE DWI GRANT COUNCIL; AMENDING A SECTION OF THE LOCAL DWI
|
0013| GRANT PROGRAM ACT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 11-6A-4 NMSA 1978 (being Laws 1993,
|
0017| Chapter 65, Section 4) is amended to read:
|
0018| "11-6A-4. DWI GRANT COUNCIL--MEMBERSHIP--DUTIES.--
|
0019| A. The "DWI grant council" is created and shall
|
0020| consist of [the president of the New Mexico municipal league,
|
the president of the New Mexico association of counties, the
|
secretary of health or the secretary's designee, the secretary
|
of finance and administration or the secretary's designee, the
|
chief of the traffic safety bureau of the state highway and
|
transportation department and two representatives of local
|
governing bodies who shall be appointed by the governor so as
|
to provide geographic diversity]:
|
0003| (1) a representative of the New Mexico
|
0004| municipal league, to be selected by the board of directors of
|
0005| the New Mexico municipal league;
|
0006| (2) a representative of the New Mexico
|
0007| association of counties, to be selected by the board of
|
0008| directors of the New Mexico association of counties;
|
0009| (3) the secretary of health or his designee;
|
0010| (4) the secretary of finance and
|
0011| administration or his designee;
|
0012| (5) the chief of the traffic safety bureau of
|
0013| the state highway and transportation department;
|
0014| (6) a representative of the public education
|
0015| system, to be selected by the state board of education;
|
0016| (7) a representative of the state judiciary,
|
0017| to be selected by the supreme court; and
|
0018| (8) two representatives of local governing
|
0019| bodies, who shall be appointed by the governor; provided that
|
0020| the governor shall ensure geographical diversity when making
|
0021| his appointments.
|
0022| B. Appointed members shall be appointed to a two-
|
0023| year term. In the event of a vacancy, the governor shall
|
0024| appoint a member for the remainder of the term.
|
0025| C. The council shall meet as necessary to receive
|
0001| applications, consider grant requests and award DWI grants
|
0002| pursuant to the Local DWI Grant Program Act. All actions of
|
0003| the council require the affirmative vote of a majority of the
|
0004| members of the council.
|
0005| D. Members of the council shall be reimbursed for
|
0006| per diem and mileage in accordance with the Per Diem and
|
0007| Mileage Act."
|
0008| Section 2. EFFECTIVE DATE.--The effective date of the
|
0009| provisions of this act is July 1, 1997.
