SHORT TITLE.--This act may be cited as the | 0015| "Family Preservation Act". | 0016| Section 2. LEGISLATIVE PURPOSE.--The purpose of the | 0017| Family Preservation Act is to confirm the state's policy of | 0018| support for the family and to emphasize the responsibilities of | 0019| parents and the state in the healthy development of children | 0020| and the family as an institution. The Family Preservation Act | 0021| is also intended to serve as a benchmark against which other | 0022| legislation can be measured to assess whether it furthers the | 0023| goals of preserving and enhancing families in New Mexico. | 0024| Section 3. FAMILY PRESERVATION GOALS--STATEMENT OF | 0025| POLICY.--It is the policy of the state that its laws and | 0001| programs should: | 0002| A. support intact, functional families and promote | 0003| each family's ability and responsibility to raise its children; | 0004| B. strengthen families in crisis and at-risk of | 0005| losing their children, so that children can remain safely in | 0006| their own homes and communities; | 0007| C. promote the creation of well-paying, stable jobs | 0008| so that families can provide for their basic needs, including | 0009| health, education, food, clothing and shelter; and | 0010| D. help halt the breakup of the nuclear family, | 0011| stabilize neighborhoods and strengthen communities. | 0012| Section 4. PARENTAL AND STATE RESPONSIBILITIES.-- | 0013| A. Parents have joint primary responsibility for | 0014| the well-being of their family. Parents have the primary | 0015| responsibility to: | 0016| (1) ensure that their children have adequate | 0017| food, shelter, medical care and a healthy environment; | 0018| (2) support their children in all ways possible | 0019| to grow up to be responsible, caring members of society; | 0020| (3) ensure that their children receive a | 0021| quality education both in and out of school to prepare them for | 0022| active and productive adult lives; | 0023| (4) protect their children from the serious | 0024| dangers of narcotics, alcohol and other harmful substances; and | 0025| (5) protect their children from all forms of | 0001| exploitation harmful to any aspect of their welfare. | 0002| B.
