ADULT MALE INMATES TRANSFERRED TO OUT-OF-STATE | 0018| CORRECTIONAL FACILITIES--LIMITED PERIOD OF TIME.--Adult male | 0019| inmates transferred to out-of-state correctional facilities for | 0020| the purpose of relieving overcrowding in New Mexico | 0021| correctional facilities may be kept in out-of-state | 0022| correctional facilities for a period of no longer than nine | 0023| months. | 0024| Section 2. APPROPRIATION.--Two million five hundred | 0025| thousand dollars ($2,500,000) is appropriated from the general | 0001| fund to the corrections department for expenditure in fiscal | 0002| year 1997 for the purpose of paying for adult male inmates | 0003| transferred to out-of-state correctional facilities to relieve | 0004| overcrowding in state correctional facilities and paying for | 0005| accompanying costs, including medical costs and transportation | 0006| costs. Any unexpended or unencumbered balance remaining at the | 0007| end of fiscal year 1997 shall revert to the general fund. | 0008| Section 3. TEMPORARY PROVISION--EARLY RELEASE.--In fiscal | 0004| years 1997 and 1998 if inmates of a custody class are in out- | 0005| of-state facilities, the corrections department shall consider | 0006| for emergency release either in-state or out-of-state | 0007| incarcerated nonviolent offender inmates in that custody class | 0008| who are within thirty days of projected release. | 0009| Section 3. APPROPRIATION.--One million one hundred | 0010| thousand dollars ($1,100,000) is appropriated from the general | 0011| fund to the corrections department for expenditure in fiscal | 0012| year 1997 for the purpose of paying for adult male inmates | 0013| transferred to out-of-state correctional facilities to relieve | 0014| overcrowding in state correctional facilities and paying for | 0015| accompanying costs, including medical costs and transportation | 0016| costs.
