0011| RELATING TO AGRICULTURE; DEFINING PURE HONEY FOR PURPOSES OF
|
0012| THE FOOD SERVICE SANITATION ACT; CREATING AN EXEMPTION.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 25-1-2 NMSA 1978 (being Laws 1977,
|
0016| Chapter 309, Section 2, as amended) is amended to read:
|
0017| "25-l-2. DEFINITIONS.--As used in the Food Service
|
0018| Sanitation Act:
|
0019| A. "agency" or "division" means the department of
|
0020| environment;
|
0021| B. "board" means the environmental improvement
|
0022| board;
|
0023| C. "employee" means any individual employed in a
|
0024| food service establishment who transports food or food
|
0025| containers, who handles food during storage, preparation or
|
0001| serving, who comes in contact with any utensils or who is
|
0002| employed in a room in which food is stored, prepared or served;
|
0003| D. "food" means any solid or liquid substance
|
0004| intended for human consumption by eating or drinking;
|
0005| E. "general public" includes beneficiaries of
|
0006| governmental feeding programs and private charitable feeding
|
0007| programs and residents and employees of institutions that
|
0008| provide meals to their residents and employees either with or
|
0009| without direct payment to the institution by the residents or
|
0010| employees;
|
0011| F. "temporary food service establishment" means a
|
0012| food service establishment that operates at a fixed location in
|
0013| conjunction with a single event or celebration for a short
|
0014| period of time not exceeding the event or celebration or not
|
0015| exceeding thirty days;
|
0016| G. "person" means an individual or any other legal
|
0017| entity;
|
0018| H. "food service establishment" means:
|
0019| (1) any fixed or mobile place where food is
|
0020| served and sold for consumption on the premises;
|
0021| (2) any fixed or mobile place where food is
|
0022| prepared for sale to or consumption by the general public
|
0023| either on or off the premises, including any place where food
|
0024| is manufactured for ultimate sale in a sealed original package,
|
0025| but "prepared" as used in this paragraph does not include the
|
0001| preparation of raw fruits, [and] vegetables or pure honey
|
0002| for display and sale in a grocery store or similar operation.
|
0003| For purposes of this paragraph, "pure honey" means natural
|
0004| liquid or solid honey, extracted from the combs or in the comb,
|
0005| taken from beehives, with no processing or additional
|
0006| ingredients. "Food service establishment" does not mean a
|
0007| dairy establishment; and
|
0008| (3) meat markets, whether or not operated in
|
0009| conjunction with a grocery store;
|
0010| I. "utensil" means any implement used in the
|
0011| storage, preparation, transportation or service of food; and
|
0012| J. "dairy establishment" means a milk processing or
|
0013| milk producing facility."
