0011| RELATING TO THE WATER QUALITY CONTROL COMMISSION; AMENDING
|
0012| SECTION 74-6-3 NMSA 1978 (BEING LAWS 1967, CHAPTER 190, SECTION
|
0013| 3, AS AMENDED).

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 74-6-3 NMSA 1978 (being Laws 1967,
|
0017| Chapter 190, Section 3, as amended) is amended to read:
|
0018| "74-6-3. WATER QUALITY CONTROL COMMISSION CREATED.--
|
0019| A. There is created the "water quality control
|
0020| commission" consisting of:
|
0021| (1) the secretary of environment or a member
|
0022| of his staff designated by him;
|
0023| (2) the director of the department of game and
|
0024| fish or a member of his staff designated by him;
|
0025| (3) the state engineer or a member of his
|
0001| staff designated by him;
|
0002| (4) the chairman of the oil conservation
|
0003| commission or a member of his staff designated by him;
|
0004| (5) the director of the state park and
|
0005| recreation division of the energy, minerals and natural
|
0006| resources department or a member of his staff designated by
|
0007| him;
|
0008| (6) the director of the New Mexico department
|
0009| of agriculture or a member of his staff designated by him;
|
0010| (7) the chairman of the soil and water
|
0011| conservation commission or a [member of his staff] person
|
0012| designated by him;
|
0013| (8) the director of the bureau of mines and
|
0014| mineral resources at the New Mexico institute of mining and
|
0015| technology or a member of his staff designated by him; and
|
0016| (9) three representatives of the public to be
|
0017| appointed by the governor for [a term] terms of four years
|
0018| and who shall be compensated from the budgeted funds of the
|
0019| department of environment in accordance with the provisions of
|
0020| the Per Diem and Mileage Act.
|
0021| B. No member of the commission shall receive or
|
0022| shall have received, during the previous two years, a
|
0023| significant portion of his income directly or indirectly from
|
0024| permit holders or applicants for a permit and shall, upon the
|
0025| acceptance of his appointment and prior to the performance of
|
0001| any of his duties, file a statement of disclosure with the
|
0002| secretary of state disclosing any amount of money or other
|
0003| valuable consideration, and its source, the value of which is
|
0004| in excess of ten percent of his gross personal income in each
|
0005| of the preceding two years, that he received directly or
|
0006| indirectly from permit holders or applicants for permits
|
0007| required under the Water Quality Act.
|
0008| C. The commission shall elect a chairman and other
|
0009| necessary officers and shall keep a record of its proceedings.
|
0010| D. A majority of the commission constitutes a
|
0011| quorum for the transaction of business, but no action of the
|
0012| commission is valid unless concurred in by six or more members
|
0013| present at a meeting.
|
0014| E. The commission is the state water pollution
|
0015| control agency for this state for all purposes of the federal
|
0016| act and the wellhead protection and sole source aquifer
|
0017| programs of the federal Safe Drinking Water Act and may take
|
0018| all action necessary and appropriate to secure to this state,
|
0019| its political subdivisions or interstate agencies the benefits
|
0020| of that act and those programs.
|
0021| F. The commission is administratively attached, as
|
0022| defined in the Executive Reorganization Act, to the department
|
0023| of environment."
