0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0012| SEVERANCE TAX BONDS FOR VARIOUS CAPITAL PROJECTS IN COLFAX
|
0013| COUNTY; MAKING APPROPRIATIONS; DECLARING AN EMERGENCY.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0017| APPROPRIATION OF PROCEEDS.--
|
0018| A. The state board of finance may issue and sell
|
0019| severance tax bonds in compliance with the Severance Tax
|
0020| Bonding Act in an amount not to exceed the total of the amounts
|
0021| authorized for purposes specified in Sections 2 through 6 of
|
0022| this act. The state board of finance shall schedule the
|
0023| issuance and sale of the bonds in the most expeditious and
|
0024| economical manner possible upon a finding by the board that the
|
0025| project has been developed sufficiently to justify the issuance
|
0001| and that the project can proceed to contract within a
|
0002| reasonable time. The state board of finance shall further take
|
0003| the appropriate steps necessary to comply with the Internal
|
0004| Revenue Code of 1986, as amended. Proceeds from the sale of
|
0005| the bonds are appropriated for expenditure in Colfax county for
|
0006| the purposes specified in Sections 2 through 6 of this act.
|
0007| B. The agencies named in Sections 2 through 6 of
|
0008| this act shall certify to the state board of finance when the
|
0009| money from the proceeds of the severance tax bonds authorized
|
0010| in this section is needed for the purposes specified in the
|
0011| applicable section of this act.
|
0012| C. If the specified agency has not certified the
|
0013| need for the issuance of the bonds by the end of fiscal year
|
0014| 1999, the authorization provided in this act shall be void.
|
0015| D. Unless otherwise specified in this act, any
|
0016| unexpended or unencumbered balance remaining from the proceeds
|
0017| of severance tax bonds issued pursuant to Sections 2 through 6
|
0018| of this act at the end of fiscal year 2000 shall revert to the
|
0019| severance tax bonding fund.
|
0020| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0021| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of
|
0022| Section 1 of this act, upon certification by the local
|
0023| government division of the department of finance and
|
0024| administration that the need exists for the issuance of the
|
0025| bonds, the following amounts are appropriated to the local
|
0001| government division of the department of finance and
|
0002| administration for the following purposes:
|
0003| A. two hundred sixty-eight thousand dollars
|
0004| ($268,000) for planning, designing, constructing and equipping
|
0005| an addition, including a kitchen, to the daycare facility at
|
0006| the Colfax county workshop for the developmentally disabled;
|
0007| B. ninety-eight thousand six hundred forty dollars
|
0008| ($98,640) for planning, designing, constructing and equipping a
|
0009| daycare addition, including paving the parking area, to the
|
0010| community multipurpose service center near Raton high school;
|
0011| C. one hundred one thousand seven hundred twenty
|
0012| dollars ($101,720) for planning, designing, constructing and
|
0013| equipping a wellness center addition to the community
|
0014| multipurpose center near Raton high school;
|
0015| D. sixty-five thousand dollars ($65,000) for
|
0016| various renovations and remodeling of the county courthouse in
|
0017| Raton, including drainage and landscaping work and improvements
|
0018| necessary for compliance with the federal Americans with
|
0019| Disabilities Act of 1990;
|
0020| E. twenty-five thousand dollars ($25,000) for
|
0021| various repairs and renovations of the county state agency
|
0022| building in Raton;
|
0023| F. ten thousand dollars ($10,000) for remodeling
|
0024| the sheriff's office in Raton for compliance with the federal
|
0025| Americans with Disabilities Act of 1990;
|
0001| G. two hundred fifty thousand dollars ($250,000)
|
0002| for electrical repairs and associated remodeling of the
|
0003| Springer town hall; and
|
0004| H. three hundred fifteen thousand dollars
|
0005| ($315,000) for planning, designing, constructing and equipping
|
0006| a community and senior citizen center in the village of
|
0007| Cimarron.
|
0008| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF
|
0009| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1
|
0010| of this act, upon certification by the department of
|
0011| environment that the need exists for the issuance of the bonds,
|
0012| the following amounts are appropriated to the department of
|
0013| environment for the following purposes:
|
0014| A. one million five hundred thousand dollars
|
0015| ($1,500,000) for planning, designing, constructing and
|
0016| equipping a water and wastewater system in the town of
|
0017| Springer;
|
0018| B. one hundred fifty thousand dollars ($150,000)
|
0019| for improvements to the water and wastewater distribution lines
|
0020| in the village of Cimarron;
|
0021| C. thirty thousand eight hundred dollars ($30,800)
|
0022| for improvements to the water and wastewater system, including
|
0023| a water filtration system, for the community of Miami; and
|
0024| D. six hundred thousand dollars ($600,000) for
|
0025| planning, designing, constructing and equipping improvements to
|
0001| the water and wastewater system in the village of Eagle Nest.
|
0002| Section 4. SEVERANCE TAX BONDS--STATE HIGHWAY AND
|
0003| TRANSPORTATION DEPARTMENT--PURPOSE.--Pursuant to the provisions
|
0004| of Section 1 of this act, upon certification by the state
|
0005| highway and transportation department that the need exists for
|
0006| the issuance of the bonds, three hundred eighty-six thousand
|
0007| seven hundred dollars ($386,700) is appropriated to the state
|
0008| highway and transportation department for the purpose of
|
0009| planning, designing, constructing and repairing various streets
|
0010| and roads in the village of Maxwell.
|
0011| Section 5. SEVERANCE TAX BONDS--STATE DEPARTMENT OF
|
0012| PUBLIC EDUCATION--PURPOSES.--Pursuant to the provisions of
|
0013| Section 1 of this act, upon certification by the state
|
0014| department of public education that the need exists for the
|
0015| issuance of the bonds, the following amounts are appropriated
|
0016| to the state department of public education for the following
|
0017| purposes:
|
0018| A. one hundred forty-five thousand dollars
|
0019| ($145,000) for the purchase and installation of educational
|
0020| technology in various Cimarron municipal schools;
|
0021| B. one hundred eighty thousand dollars ($180,000)
|
0022| for various improvements to the vocational education
|
0023| laboratories at Cimarron high school and Eagle Nest and
|
0024| Cimarron middle schools;
|
0025| C. two hundred seventy thousand dollars ($270,000)
|
0001| for planning, designing, constructing and equipping restrooms
|
0002| in the new student commons at Cimarron high school; and
|
0003| D. sixty-two thousand dollars ($62,000) for
|
0004| purchase and installation of equipment, landscaping and other
|
0005| necessary improvements to playgrounds at Eagle Nest and
|
0006| Cimarron elementary schools.
|
0007| Section 6. SEVERANCE TAX BONDS--OFFICE OF CULTURAL
|
0008| AFFAIRS--PURPOSE.--Pursuant to the provisions of Section 1 of
|
0009| this act, upon certification by the office of cultural affairs
|
0010| that the need exists for the issuance of the bonds, one hundred
|
0011| thousand dollars ($100,000) is appropriated to the office of
|
0012| cultural affairs for purchasing and equipping a rural library
|
0013| services bookmobile, based in Cimarron, to serve north central
|
0014| and northeast New Mexico.
|
0015| Section 7. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect immediately.
|
