JOHNSON | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR THE RENOVATION, REPAIR AND IMPROVEMENT | 0013| OF STATE BUILDINGS THROUGHOUT THE STATE AND FOR PURCHASING | 0014| EQUIPMENT FOR VARIOUS STATE AGENCIES; MAKING AN APPROPRIATION | 0015| FROM THE PUBLIC BUILDINGS REPAIR FUND; MAKING APPROPRIATIONS; | 0016| DECLARING AN EMERGENCY. | 0017| | 0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0019| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0020| APPROPRIATION OF PROCEEDS.-- | 0021| A. The state board of finance may issue and sell | 0022| severance tax bonds in compliance with the Severance Tax | 0023| Bonding Act in an amount not to exceed the total of the amounts | 0024| authorized for purposes specified in Sections 2 through 5 of | 0025| this act. The state board of finance shall schedule the | 0001| issuance and sale of the bonds in the most expeditious and | 0002| economical manner possible upon a finding by the board that the | 0003| project has been developed sufficiently to justify the issuance | 0004| and that the project can proceed to contract within a | 0005| reasonable time. The state board of finance shall further take | 0006| the appropriate steps necessary to comply with the Internal | 0007| Revenue Code of 1986, as amended. Proceeds from the sale of | 0008| the bonds are appropriated for the purposes specified in | 0009| Sections 2 through 5 of this act. | 0010| B. The agencies named in Sections 2 through 5 of | 0011| this act shall certify to the state board of finance when the | 0012| money from the proceeds of the severance tax bonds authorized | 0013| in this section is needed for the purposes specified in the | 0014| applicable section of this act. | 0015| C. If the specified agency has not certified the | 0016| need for the issuance of the bonds by the end of fiscal year | 0017| 1999, the authorization provided in this act shall be void. | 0018| D. Unless otherwise specified in this act, any | 0019| unexpended or unencumbered balance remaining from the proceeds | 0020| of severance tax bonds issued pursuant to Sections 2 through 5 | 0021| of this act at the end of fiscal year 2000 shall revert to the | 0022| severance tax bonding fund. | 0023| Section 2. SEVERANCE TAX BONDS--PROPERTY CONTROL DIVISION | 0024| OF THE GENERAL SERVICES DEPARTMENT--PURPOSES.--Pursuant to the | 0025| provisions of Section 1 of this act, upon certification by the | 0001| property control division of the general services department | 0002| that the need exists for the issuance of the bonds, the | 0003| following amounts are appropriated to the property control | 0004| division of the general services department for the following | 0005| purposes: | 0006| A. five hundred thousand dollars ($500,000) to | 0007| replace chiller freon and other refrigeration equipment | 0008| throughout the state; | 0009| B. eight hundred thousand dollars ($800,000) to | 0010| repair and replace boiler units and install water treatment | 0011| systems for boilers located throughout the state; | 0012| C. four hundred thousand dollars ($400,000) to | 0013| perform renovation and repairs to state buildings located | 0014| throughout the state; | 0015| D. one million dollars ($1,000,000) for roof | 0016| replacement and related repairs at state buildings located | 0017| throughout the state; | 0018| E. two hundred thousand dollars ($200,000) to plan, | 0019| design and make improvements to state buildings located | 0020| throughout the state in order to comply with the federal | 0021| Americans with Disabilities Act of 1990; | 0022| F. eight hundred thousand dollars ($800,000) to | 0023| plan, design and make improvements to parking lots and other | 0024| paving at state buildings located throughout the state; | 0025| G. two hundred thirty-five thousand five hundred | 0001| dollars ($235,500) to remodel, repair and make improvements to | 0002| the office of the income support division of the human services | 0003| department in Espanola located in Rio Arriba county; | 0004| H. four hundred twenty thousand dollars ($420,000) | 0005| to complete renovation of and repair the office of the income | 0006| support division of the human services department in southeast | 0007| Bernalillo county; | 0008| I. one million dollars ($1,000,000) to renovate and | 0009| make improvements to the Fort Bayard medical center in Fort | 0010| Bayard located in Grant county; | 0011| J. seventy-five thousand four hundred dollars | 0012| ($75,400) to plan, design and install an emergency backup | 0013| generator for the New Mexico veterans' center located in Sierra | 0014| county; | 0015| K. ninety thousand dollars ($90,000) to renovate | 0016| and make improvements to the New Mexico rehabilitation center | 0017| located in Chaves county in order to comply with the federal | 0018| Americans with Disabilities Act of 1990; | 0019| L. four hundred fifty thousand dollars ($450,000) | 0020| to replace the water tower at the Fort Bayard medical center | 0021| located in Grant county; | 0022| M. one million three hundred eighty-two thousand | 0023| dollars ($1,382,000) to plan, design, renovate, furnish and | 0024| equip the Maloof building in Albuquerque in Bernalillo county | 0025| in order for the building to be used by other state agencies; | 0001| N. two hundred seventy-one thousand dollars | 0002| ($271,000) to make mechanical improvements at the Sequoyah | 0003| adolescent treatment center located in Bernalillo county; | 0004| O. one hundred fifteen thousand six hundred dollars | 0005| ($115,600) to replace the gym flooring at the Las Vegas medical | 0006| center located in San Miguel county; | 0007| P. two hundred thirty-five thousand seven hundred | 0008| dollars ($235,700) to plan, design, renovate or make | 0009| improvements to the Raton point-of-entry located in Colfax | 0010| county; and | 0011| Q. five hundred thousand dollars ($500,000) to | 0012| renovate and make improvements to the Albuquerque training | 0013| center for the commission for the blind located in Bernalillo | 0014| county. | 0015| Section 3. SEVERANCE TAX BONDS--GENERAL SERVICES | 0016| DEPARTMENT--PURPOSES.--Pursuant to the provisions of Section 1 | 0017| of this act, upon certification by the general services | 0018| department that the need exists for the issuance of the bonds, | 0019| nine hundred sixty thousand dollars ($960,000) is appropriated | 0020| to the general services department to purchase and install | 0021| digital mobile data equipment, including data two-way radios | 0022| and interface equipment, to allow secure transmittal of | 0023| sensitive data to certain state agency vehicles. | 0024| Section 4. SEVERANCE TAX BONDS--OFFICE OF CULTURAL | 0025| AFFAIRS--PURPOSES.--Pursuant to the provisions of Section 1 of | 0001| this act, upon certification by the office of cultural affairs | 0002| that the need exists for the issuance of the bonds, one million | 0003| three hundred thousand dollars ($1,300,000) is appropriated to | 0004| the office of cultural affairs to renovate, repair and make | 0005| improvements to state museums and facilities located throughout | 0006| the state. | 0007| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF MILITARY | 0008| AFFAIRS--PURPOSES.--Pursuant to the provisions of Section 1 of | 0009| this act, upon certification by the department of military | 0010| affairs that the need exists for the issuance of the bonds, | 0011| four hundred thousand dollars ($400,000) is appropriated to the | 0012| department of military affairs to renovate, repair and make | 0013| improvements to various armories located throughout the state. | 0014| Section 6. APPROPRIATION--PUBLIC BUILDINGS REPAIR FUND-- | 0015| PURPOSES.-- | 0016| A. The following amounts are appropriated from the | 0017| public buildings repair fund to the property control division | 0018| of the general services department for the purposes specified | 0019| below: | 0020| (1) five hundred thousand dollars ($500,000) to | 0021| replace chiller freon and other refrigeration equipment | 0022| throughout the state; | 0023| (2) seven hundred thousand dollars ($700,000) | 0024| to repair and replace boiler units and install water treatment | 0025| systems for boilers located throughout the state; | 0001| (3) six hundred thousand dollars ($600,000) | 0002| for roof replacement and related repairs at state buildings | 0003| located throughout the state; | 0004| (4) four hundred thousand dollars ($400,000) | 0005| to renovate and repair state buildings located throughout the | 0006| state; and | 0007| (5) two hundred thousand dollars ($200,000) to | 0008| plan, design and make improvements to state buildings located | 0009| throughout the state in order to comply with the requirements | 0010| of the federal Americans with Disabilities Act of 1990. | 0011| B. Any unexpended or unencumbered balance remaining | 0012| at the end of fiscal year 2001 shall revert to the public | 0013| buildings repair fund. | 0014| Section 7. EMERGENCY.--It is necessary for the public | 0015| peace, health and safety that this act take effect immediately | 0016|  |
